The protection period of Polish invention patents is 20 years from the date of application. The definition of invention under Polish Patent Law is: "Invention refers to a new technical solution proposed for a product, method or improvement thereof."
p>The application process for invention patents in Poland is roughly the same as that in my country. The difference is that the applicant needs to submit a declaration claiming priority within three months after the filing date, and submit documents proving its prior application in the designated country or occasion. In my country, the priority statement must be submitted to the Patent Office when submitting the application.
The Patent Office will first conduct a formal examination of the application and publish the patent 18 months after the filing date or the priority date. The applicant may submit a request for early disclosure 12 months after the priority date. After substantive examination by the Patent Office, the patent right is granted.
