Measures of the State Tobacco Monopoly Bureau for Appraisal of Scientific and Technological Achievements

Chapter I General Provisions Article 1 In order to strengthen the appraisal management of scientific and technological achievements (hereinafter referred to as scientific and technological achievements), correctly judge the quality and level of scientific and technological achievements, promote the perfection and improvement of scientific and technological achievements, and speed up the popularization and application of scientific and technological achievements, according to the Law of People's Republic of China (PRC) on Scientific and Technological Progress, the Law of People's Republic of China (PRC) on Tobacco Monopoly and the scientific and technological achievements of People's Republic of China (PRC) State Science and Technology Commission, Article 2 Appraisal of scientific and technological achievements means that the State Tobacco Monopoly Bureau employs experts from the same industry to review and evaluate scientific and technological achievements in accordance with the prescribed forms and procedures, and make corresponding conclusions. Article 3 The appraisal of scientific and technological achievements shall adhere to the principles of seeking truth from facts, being scientific and democratic, being objective and fair, paying attention to quality and practical results, and ensuring the seriousness and scientificity of appraisal of scientific and technological achievements. Article 4 Appraisal of scientific and technological achievements is one of the methods to evaluate the quality and level of scientific and technological achievements. The State Tobacco Monopoly Bureau encourages the evaluation and identification of scientific and technological achievements through market competition and academic contention. Article 5 The State Tobacco Monopoly Bureau shall administer, guide and supervise the appraisal of scientific and technological achievements in the tobacco industry.

The tobacco monopoly bureaus of all provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the management and supervision of the identification of scientific and technological achievements in their respective regions under the premise of authorization or entrustment by the State Tobacco Monopoly Bureau. Article 6 Identification of tobacco scientific and technological achievements is the main basis for achievement award, popularization and application, technology export, etc. In addition to the above functions, tobacco monopoly product identification is the basic basis for fixed-point production, monopoly license issuance and product pricing. Chapter II Scope of Appraisal Article 7 The achievements of tobacco application technology included in the science and technology plan of the state, the State Tobacco Monopoly Bureau, the tobacco monopoly bureaus (companies) of provinces, autonomous regions and municipalities directly under the Central Government and the relevant departments of the State Council (hereinafter referred to as the science and technology plan), as well as a few major application technology achievements related to the tobacco industry outside the science and technology plan, shall be appraised in accordance with these Measures.

Measures for the acceptance and evaluation of scientific and technological achievements such as basic research and soft science research within the science and technology plan shall be formulated separately by the State Tobacco Monopoly Bureau in accordance with the relevant provisions of the State Science and Technology Commission. Eighth the following scientific and technological achievements are not identified:

(a) basic theoretical research results;

(two) soft science research results;

(3) Applied technological achievements for which a patent has been applied;

(4) Applied technological achievements that have been transferred and implemented;

(five) the general application of technological achievements developed by enterprises and institutions (the general application of technological achievements refers to excluding tobacco monopoly products and cigarette testing instruments);

(6) Scientific and technological achievements that must be examined and confirmed by statutory specialized agencies as stipulated by national laws and regulations. Ninth in violation of the provisions of national laws and regulations, causing damage to public interests or environmental resources, the application for evaluation will not be accepted. If the appraisal is in progress, it shall be stopped, and if it has passed the appraisal, it shall be revoked. Chapter III Appraisal Organization Article 10 Appraisal shall be organized by the science and technology department of the State Tobacco Monopoly Bureau (hereinafter referred to as appraisal organization). When necessary, the science and technology departments of tobacco monopoly bureaus of provinces, autonomous regions and municipalities directly under the Central Government may be authorized to organize the appraisal, or the relevant units (hereinafter referred to as appraisal units) may be entrusted to preside over the appraisal. Eleventh organizational appraisal units and the appraised units can choose the following appraisal forms according to the characteristics of scientific and technological achievements:

(1) Testing and appraisal: refers to the evaluation of scientific and technological achievements by professional technical testing institutions through the inspection and testing of performance indicators.

(2) Conference appraisal: refers to peer experts' evaluation of scientific and technological achievements in the form of conferences. Scientific and technological achievements that need on-the-spot investigation and testing and can only be evaluated after discussion and defense can be identified in the form of meeting identification.

(3) Letter evaluation: refers to peer experts' evaluation of scientific and technological achievements through written review of relevant technical materials. Scientific and technological achievements that can be evaluated without on-site inspection, testing and defense can be appraised by letter. Article 12 When testing and appraisal is adopted, the organization appraisal unit or the presiding appraisal unit shall designate the state and the provinces, autonomous regions, municipalities directly under the Central Government, the State Tobacco Monopoly Bureau or the professional and technical inspection institutions recognized by the relevant departments of the State Council for inspection and appraisal. The test report issued by professional technical testing institutions is the main basis for testing and appraisal. When necessary, the organization identification unit or the host identification unit may, in conjunction with the testing institution, hire three to five peer experts, set up a testing and identification expert group, and put forward comprehensive evaluation opinions. Thirteenth when using the conference appraisal, the organization appraisal unit or the host appraisal unit shall apply for seven to fifteen peer experts to form an appraisal committee. Experts attending the meeting of the appraisal committee shall not be less than 4/5 of the candidates, and the appraisal conclusion must be passed by more than 2/3 of the experts of the appraisal committee or more than 3/4 of the experts attending the meeting. Fourteenth by letter review, the organization review unit or the host review unit shall employ 5 to 9 peer experts to form a letter review group. The experts who put forward the opinions of the letter review shall not be less than 4/5 of the candidates, and the appraisal conclusion must be formed on the basis of the opinions of more than 3/4 of the experts in the letter review group. Fifteenth peer experts hired by the organization appraisal unit or the host appraisal unit shall meet the following conditions:

(a) with senior technical positions (under special circumstances, with intermediate technical positions of young and middle-aged scientific and technological backbone shall not exceed a quarter);

(two) have rich theoretical knowledge and practical experience in the identified scientific and technological achievements, and be familiar with the technical development in this field at home and abroad;

(3) Having good scientific ethics and professional ethics.

Personnel of units that have completed the appraisal of scientific and technological achievements shall not participate in the appraisal of such achievements as peer experts.

Non-special circumstances, the organization identification unit and the host identification unit generally do not hire non-professionals as members of the identification Committee, testing expert group or letter review group.

According to the needs of the work, the personnel of the task-issuing unit or the entrusting unit can participate in the achievement appraisal as peer experts.
