Regulations of Sichuan Province on Pesticide Management

Article 1 These Regulations are formulated in accordance with the Regulations of the People's Republic of China on the Administration of Pesticides and in light of the actual situation in Sichuan, with a view to strengthening the supervision and management of the production, management and use of pesticides, ensuring the quality of pesticides, protecting agricultural and forestry production and the ecological environment, and ensuring the safety of people and animals. Article 2 The production, marketing and use of pesticides (including the production of original drugs, preparation processing and sub-packaging, the same below) within the administrative area of Sichuan Province must abide by these regulations. Third provincial agricultural administrative departments are responsible for pesticide registration, pesticide quality monitoring and identification and law enforcement supervision and management. Agricultural administrative departments at or above the county level shall be responsible for the supervision and administration of pesticides within their respective administrative areas.

Other relevant departments of the people's governments at or above the county level shall be responsible for the supervision and administration of pesticides within their respective statutory duties. Article 4 The production of pesticides, fertilizers containing pesticide active ingredients, imported pesticides and sub-packaged pesticides must apply for pesticide registration.

The application for pesticide registration shall be submitted to the provincial administrative department of agriculture. The specific work shall be handled by the pesticide inspection institution affiliated to the provincial agricultural administrative department. Article 5 An entity applying for pesticide registration shall submit pesticide sample data such as chemistry, toxicology, efficacy, residue, environmental impact and labeling of pesticide products to the pesticide inspection agency under the provincial agricultural administrative department.

The efficacy test and toxicology test for pesticide registration must be carried out by qualified units stipulated by the state. Units with test qualifications shall not register their pesticide products for test. The pesticide testing institutions affiliated to the sixth provincial administrative department of agriculture shall, after receiving the pesticide registration materials and pesticide samples, timely review them and notify the applicant in writing within 30 days. Article 7 Pesticide products applying for registration must have pesticide labels examined and approved by pesticide testing institutions affiliated to agricultural administrative departments at or above the provincial level. The pesticide labels include:

(a) the name, trade name and generic name of the pesticide;

(2) Effective ingredients, content, dosage form and net weight or net content;

(3) pesticide registration certificate number;

(four) pesticide production license number (or production approval number) and product standard number, except for imported raw drugs;

(5) Color marks and toxicity marks of pesticide categories;

(six) product performance, instructions and precautions;

(7) Production date (batch number); The packaging date (batch number) of pesticides must be marked at the same time;

(8) Quality guarantee period;

(9) The name, address, telephone number and postal code of the enterprise; When repackaging pesticides, the names of the production and repackaging enterprises must be marked at the same time.

If the pesticide label really cannot record the contents of the preceding paragraph, it shall be accompanied by a description with the same effect as the label to supplement and improve the contents of the preceding paragraph.

If the approved pesticide label needs to be changed, it shall be submitted for approval again.

It is forbidden to forge, alter or change pesticide labels without authorization. Article 8 Where a registered pesticide changes its dosage form, content, scope of use and method of use within the validity period of registration, it shall apply for change of registration.

If it is necessary to continue production and operation after the expiration of the validity period of pesticide registration, it must apply for renewal of registration within 30 days before the expiration of the validity period; Failing to apply for renewal of registration within the time limit shall be deemed as automatic cancellation of registration. Ninth pesticide production management, must be strictly in accordance with the relevant laws and regulations of the state. Tenth the following units can apply for pesticide business:

(1) Business units of agricultural means of production of supply and marketing cooperatives;

(2) plant protection station;

(3) Soil and fertilizer station;

(4) Agricultural and forestry technology popularization institutions;

(5) Forest pest control institutions;

(6) Pesticide production enterprises;

(seven) other business units as prescribed by the State Council.

If the above-mentioned units set up outlets to operate pesticides, they should strengthen the management of outlets and bear legal responsibility for the behavior of outlets. Business outlets shall not set up outlets to operate pesticides.

The right to operate pesticides shall not be transferred or leased.

The provisions of this article shall not apply to the business of hygienic pesticides. Eleventh prohibit pesticide supervision and law enforcement units and their staff to participate in pesticide business activities. Twelfth units and outlets engaged in pesticide business must meet the following conditions:

(a) pesticide operators must participate in the relevant pesticide laws, regulations and knowledge training, and pass the examination by the administrative department of agriculture at or above the county level;

(2) Having business premises, equipment, storage facilities, safety protection measures and facilities and measures for preventing and controlling environmental pollution that are suitable for the pesticides it deals in;

(3) Having rules and regulations suitable for the pesticides it deals in;

(4) Having a quality management system and management means suitable for the pesticides it deals in. Article 13 Where an entity applying for pesticide business meets the conditions stipulated in Articles 10 and 12 of these Regulations, it shall apply for a business license from the administrative department for industry and commerce according to law with a pesticide business license issued by the agricultural administrative department at or above the county level. Article 14 When purchasing pesticides, pesticide business units or business outlets shall obtain a copy of pesticide registration certificate, production license (or production approval document) from the production enterprise (or supplier), and check with the contents marked on the label of pesticide products before purchasing.
