If you avoid the examination opinions of American appearance patents?

Unfortunately, you have received the review opinions of the drawings from the United States Patent and Trademark Office. Fortunately, we can use this to correct the shortcomings in the application. The examination opinions of design patents may be entirely due to problems in drawings.

Fortunately, many problems in the design patent drawings have remedies. If you don't submit your drawings according to the patent drawing rules, your drawings are likely to be rejected. When putting forward the review comments, the US Patent and Trademark Office will send a communication letter "Office Action Summary-Form Ptol-326 (Rev.08-06)", which will indicate whether the review comments are final or not, and give the time to reply to the review comments, related expenses, contact information of the examiner and how to reply. In the review report, find the column of "detailed actions", find out the problems, and attach detailed review opinions. It is possible for the examiner to explain why the drawing or alternative drawing cannot overcome the examination opinions. The examiner will not only ask questions, but also propose solutions to them.

When resubmitting the revised drawings, although only one drawing has been revised, a whole set of drawings must be resubmitted, and the header of each drawing must be marked with "replacement page" or "new page". If a drawing is discarded, the modified page must be deleted from the replacement page, the remaining drawings need to be renumbered, and the picture description should be consistent with the modified drawing.

To apply for an appearance patent in the United States, the drawings must show a three-dimensional structure with clear structure, including design features, and meet the standards that people in the industry can manufacture products according to the drawings.

If some aspects of the drawings are inconsistent or the design is not fully disclosed, it is not allowed to modify the drawings unless new inventions and new items will not be added after modification. (new matter can't add or delete things that don't exist in the original picture)

It is unwise to submit drawings of patent for appearance that are not drawn according to the standard, especially "any incomplete and nonstandard drawings may lead to incomplete disclosure of rights, and you cannot apply for a patent." Review opinions, in this case, improving the drawings will add new substances.

Next time, we will introduce more reasons for refusal and matters needing attention.
