Urban residents, rural villagers and other personnel permitted by the state who have reached the age of 16, have business ability, and have funds and venues suitable for production and operation may apply for engaging in individual production and operation activities. Article 3 These Regulations shall apply to persons engaged in individual production and business activities within the administrative area of Sichuan Province. Article 4 People's governments at all levels should adhere to the principle of giving priority to the public sector of the economy, giving consideration to the long-term development of various economic sectors and the principle of fair competition, and actively guide and support the development of individual economy. Ethnic minority areas and poverty-stricken areas should vigorously develop individual economy. Article 5 The legitimate business activities and other legitimate rights and interests of individual industrial and commercial households are protected by state laws, and no department, unit or individual may infringe upon them. Chapter II Registration Article 6 A citizen who applies for engaging in individual industry and commerce shall apply for registration with the administrative department for industry and commerce in the place where he operates with a written application and identity certificate. Where laws and regulations stipulate that producers and operators need to meet specific conditions or need special examination and approval, they shall also provide corresponding approval documents when applying.
Ethnic autonomous areas and poverty-stricken counties that apply to engage in individual industry and commerce (except special industries) may engage in production and business activities before registering. Article 7 The administrative department for industry and commerce shall issue a business license to those who meet the registration requirements within 15 days from the date of accepting the application; If it does not meet the requirements, it shall not be registered, and the applicant shall be notified in writing and the reasons shall be explained.
The relevant administrative organ responsible for examining and approving the specific conditions for the opening of individual industrial and commercial households and the specific examination and approval items shall handle the application within 15 days from the date of receiving the application, and issue approval documents to those who approve it; If it is not approved, it shall notify the applicant in writing and explain the reasons.
The administrative department for industry and commerce and the relevant administrative organs may extend the registration period due to special circumstances and notify the applicant that the extension period shall not exceed fifteen days.
The administrative department for industry and commerce and the relevant administrative organs shall simplify the procedures and give priority to those who apply to engage in key development industries such as production, science and technology. Article 8 Individual industrial and commercial households shall, within 30 days from the date of obtaining the business license, go through the tax registration with the local tax authorities, receive, use and keep invoices in accordance with state regulations, and establish account books. Article 9 Individual industrial and commercial households shall operate as individuals or families. Personal business, with personal property to bear civil liability; Family business shall bear civil liability with family property. Article 10 Individual industrial and commercial households may adopt various modes of operation, such as self-production, purchase and sale, processing with supplied materials, and engaging in wholesale and retail. Can contract, lease and purchase state-owned enterprises and collective enterprises; Be able to carry out foreign trade activities; Can be jointly operated with other economic entities, and bear corresponding civil liabilities in accordance with the agreement and articles of association. At the time of registration, the economic nature of all parties remains unchanged. Eleventh individual industrial and commercial households can focus on one industry, comprehensive management. In addition to the laws, regulations and national policies expressly stipulate that individual industrial and commercial households are not allowed to produce and operate industries and commodities, others can produce and operate. Chapter III Rights and Obligations Article 12 Individual industrial and commercial households shall enjoy the following rights according to law:
(a) according to the needs of production and operation, enjoy the exclusive right to the name approved and registered within the prescribed scope;
(two) to operate independently according to law within the scope of approval and registration;
(3) Applying for change, suspension or closure;
(four) to participate in the evaluation of technical titles;
(5) Recruiting helpers, apprentices and dismissing helpers and apprentices according to law;
(six) to decide on labor remuneration and income distribution independently;
(seven) to formulate their own commodity prices and service charges (except state price);
(eight) to conclude, change or terminate the economic contract according to law;
(9) Opening an account with a business license in a bank or other financial institution and applying for a loan;
(10) Print business seal and contract seal with business license;
(eleven) to apply for and obtain the patent right and the exclusive right to use a registered trademark according to law;
(twelve) in accordance with the relevant provisions of the state, advertising;
(thirteen) enjoy property ownership and inheritance rights according to law;
(14) Other rights granted by laws and regulations. Thirteenth individual industrial and commercial households have the right to ask the people's government to protect their legitimate rights and interests, and have the right to refuse other fees, fines, apportionment and over-standard fees other than those stipulated by laws, regulations and the provincial people's government. Fourteenth individual industrial and commercial households legally use the production and business premises, and no unit or individual may occupy them without authorization. Due to the construction needs of expropriation, the construction unit shall be responsible for proper placement and compensation for the demolition, and give appropriate economic compensation for losses. Fifteenth individual industrial and commercial households shall bear the following obligations:
(a) engaged in production and business activities in accordance with the registration items approved by the administrative department for Industry and commerce;
(2) Paying taxes according to law;
(3) Accepting the supervision of consumers;
(four) accept the supervision and management of the state administrative organs;
(five) to perform the contract and repay the debts;
(six) clearly marked, bright business;
(seven) to pay the management fees of individual industrial and commercial households on time;
(eight) other obligations stipulated by laws and regulations.
