First, the implementation date of the law, that is, the time when the law takes effect, also known as the time effect of the law, refers to the question of when the law takes effect and when it fails, and whether the law has retrospective effect on the events and behaviors before the publication. The law stipulates when it will take effect. The effective time of this law is 1 April, 9851day, that is, it will take effect from that date. However, it should be noted that the implementation date only applies to the unmodified part, not to the later modified part. The clauses modified by 1992 on September 4th shall take effect from 1 October 1 day 1993, and the clauses modified before August 25th, 2000 shall take effect from July1day. This is stipulated in several revision decisions of the National People's Congress Standing Committee (NPCSC). According to the principle of non-retroactivity of the law, the provisions of the law at that time should be implemented for patent applications and other issues that occurred before the decision to amend this law came into effect.
Two, this law and the decision to amend this law from the date of promulgation to the date of implementation for a period of time. The interval between promulgation and implementation of this amendment decision is more than nine months (promulgation date is 65438+February 27th, 2008, and implementation date is 65438+2009 10/0). This is mainly because there is still a lot of work to be done before the implementation of this revision decision, including: the relevant departments in the State Council and the State Council need to revise some original laws and regulations according to the revised new laws and regulations, and the revision work will take some time; The staff of the patent administration organ and the staff of the relevant judicial organs also have a process of learning and mastering the revised law; After the revised decision is promulgated, there is also a process of publicity and popularization to the society.
