Is the patent number the application number?

That's not true. When submitting a patent, the acceptance notice issued by the Patent Office is printed with a serial number, such as 201012652531.6, which is the application number of the invention patent. Until this patent is authorized to get a patent certificate, the application number can really become the patent number. So don't think that the application number is the patent number just because you have applied for a patent. There are uncertain factors in patent application, so don't think that the application number is equivalent to the patent number with great interest, especially when the application number of the invention patent is issued, because the application of the invention patent needs to consider the substantive examination of the patent, so it is possible to apply for a patent for more than two years or more than three years. Before the application fails, do not use the patent, which is classified as the patent number.

Problems needing attention in applying for invention patent

1. Filling and writing of patent application documents

There are specific requirements for the filling and writing of patent application documents, and the applicant can fill in and write them by himself or entrust a patent agency to handle them on his behalf. Although it is not mandatory to entrust a patent agency, considering the importance of carefully writing patent application documents and the legal rigor of examination and approval procedures, it is worth promoting for applicants with little experience.

2. Acceptance of patent applications

After receiving the patent application, the Patent Office's acceptance office or the Patent Office's agency shall determine the application date, give the application number and issue a notice of acceptance for the application that meets the acceptance conditions.

3. Payment method of application fee

The application fee and other fees can be paid directly to the toll office or agency of the Patent Office, or remitted through the bank or post office. At present, banks use electronic transfer and post offices use electronic remittance. When paying the patent fee through the post office or bank, the payer shall indicate the correct application number or patent number on the money order, and shall abbreviate the name of the payer. The remitter should ask the bank or post office staff to enter the above payment information in the remittance postscript column. If you remit money through the post office, you should also ask the post office staff to enter the complete mailing address, including the postal code, which will play an important role in future procedures. Fees shall not be sent to the Patent Office.

What are the conditions for granting a patent for invention?

An invention-creation granted a patent right shall meet the following conditions:

(1) Novelty means that before the filing date, no identical invention or utility model was published in publications at home and abroad, used in China or known to the public in other ways, and after the filing date, no identical invention or utility model was applied to the patent administration department in the State Council by others and recorded in the patent application documents with foresight.

(2) Creativity means that the invention has outstanding substantive features and remarkable progress compared with the prior art before the filing date. The utility model has substantial characteristics and progress.

(3) Practicality means that the invention or utility model can be manufactured or used and can produce positive effects.

This Law is based on Article 120 of the Detailed Rules for the Implementation of the Patent Law of People's Republic of China (PRC).

When mailing documents related to the application or patent right to the patent administration department of the State Council, registered letters shall be used, and parcels shall not be used. In addition to submitting the patent application documents for the first time, when submitting all kinds of documents and going through all kinds of formalities to the patent administration department of the State Council, the application number or patent number, the name of the invention-creation and the name of the applicant or patentee shall be indicated.
