The evaluation of scientific theoretical achievements should follow the academic policy of letting a hundred schools of thought contend; The evaluation of technological achievements should be based on the economic and social benefits after their release, and should be appraised, evaluated and recognized by the society through the market mechanism. Generally, appraisal may not be organized. Third scientific and technological achievements completed by the implementation of the national science and technology plan projects; Scientific and technological achievements declared as scientific and technological awards, as well as other scientific and technological achievements that should be appraised in accordance with the relevant provisions of the state, shall be appraised in accordance with these measures and provide appraisal reports for the reference of relevant departments. Article 4 The appraisal of scientific and technological achievements may take the following forms:
(1) detection and appraisal: professional detection institutions conduct inspection, detection and evaluation according to national standards, industry standards or relevant technical indicators, and draw conclusions;
(2) Acceptance appraisal: the acceptance unit tests, evaluates and draws conclusions according to the plan task or the specified acceptance standards and methods;
(3) Expert review: peer experts review the technical data related to scientific and technological achievements in written form, and organize appraisal units to summarize and make conclusions. For scientific and technological achievements belonging to major projects of the state, province and Ministry, an expert appraisal meeting may be held when necessary to review and evaluate the scientific and technological achievements and draw a conclusion. Article 5 The scientific and technological achievements that need to be appraised according to the provisions of Article 3 of these Measures shall be deemed to have passed the appraisal under any of the following circumstances:
(a) the production practice proves that the technology is mature and has achieved economic and social benefits, and the implementation unit issues a certificate;
(two) the technical project registered by the technology contract registration authority has passed the acceptance according to the contract, and has achieved social and economic benefits through production practice and application, and the party concerned has issued a certificate;
(3) The invention patent granted by China Patent Office has achieved economic benefits after implementation, and the implementing unit has issued a certificate. Article 6 The achievement management institution of the State Science and Technology Commission is responsible for the centralized management of the appraisal of national scientific and technological achievements, and is responsible for organizing or entrusting relevant units to organize the appraisal of major scientific and technological achievements.
The achievement management institutions of local science and technology commissions at all levels are responsible for the appraisal of scientific and technological achievements in their respective regions, and organize or entrust relevant units to organize the appraisal of scientific and technological achievements in their respective regions.
The achievement management institutions of relevant departments in the State Council are responsible for the appraisal of scientific and technological achievements of their own departments, and organize or entrust relevant units to organize the appraisal of scientific and technological achievements of their own systems. Article 7 Where the ownership of scientific and technological achievements is disputed, it shall be appraised after the dispute is resolved. Eighth of the scientific and technological achievements that need to be identified, the appraisal institution shall employ experts to form an appraisal committee to determine the appropriate appraisal form according to the different nature of scientific and technological achievements.
The members of the appraisal committee shall be representative and meet the following conditions:
(a) with senior or intermediate professional and technical positions in the industry or field;
(2) Having a high academic and technical level and rich practical experience;
(3) Having good professional ethics.
Members of the evaluation committee shall not participate in the research; The number of personnel participating in the appraisal committee of units that have completed scientific and technological achievements shall not exceed 1/4 of the total number of members of the appraisal committee. Ninth scientific and technological achievements appraisal work should adhere to the principles of seeking truth from facts, seriousness, simplicity and economy. The appraisal committee shall, in accordance with the principle that the minority is subordinate to the majority, review and comment on the scientific value, technical level, academic level, technical maturity and economic rationality of scientific and technological achievements, and record the appraisal conclusion in the appraisal report.
Members of the appraisal committee have the obligation to keep confidential the scientific and technological achievements that have been appraised, and are responsible for the appraisal report. If there is any objection to the appraisal conclusion, it shall be indicated in the appraisal report. Article 10 The unit that organizes appraisal shall carefully examine the appraisal report submitted by the appraisal committee. If major defects are found in the appraisal report, the original appraisal committee shall be instructed to supplement the appraisal evaluation; If the appraisal report is found to be fraudulent or formalistic in the appraisal work, it has the right to reject the appraisal report and organize the appraisal committee to conduct a new appraisal.
After the appraisal report is examined and approved, the organization appraisal unit shall issue an appraisal certificate to the qualified scientific and technological achievements. Article 11 Measures for the appraisal of military scientific and technological achievements shall be formulated by relevant departments with reference to these Measures.
