Chapter 1 General Provisions
Chapter Article 1 In order to strengthen and standardize the management of Sichuan Provincial Key Laboratory (hereinafter referred to as "Provincial Key Laboratory"), promote the construction of the province's scientific and technological innovation system and scientific research platform, and improve the level of scientific and technological innovation and continuous innovation capabilities, these measures are specially formulated.
Article 2 The provincial key laboratory is a relatively independent scientific research entity built on the basis of scientific research institutions, universities and high-tech enterprises with strong scientific research capabilities in the administrative region of the province.
The Provincial Key Laboratory is an important part of our province’s scientific and technological innovation system. It is an important base for our province to carry out basic and applied basic research, gather and cultivate outstanding scientific and technological talents, and conduct foreign scientific and technological cooperation and exchanges.
Article 3 The main tasks of the Provincial Key Laboratory are: to carry out innovative research around the strategic goals of our province’s economic, social and scientific and technological development, to obtain original innovation results and independent intellectual property rights, and to solve our province’s economic problems. Provide strategic, basic, forward-looking knowledge reserves and technical support for outstanding issues related to social development; attract, stabilize, and cultivate a team of scientific and technological talents; strengthen domestic and foreign scientific and technological cooperation and exchanges.
Chapter 2 Management Responsibilities
Article 4 The Sichuan Provincial Department of Science and Technology (hereinafter referred to as the "Provincial Department of Science and Technology") is the macro management department of the Provincial Key Laboratory. Its main responsibilities are: : Implement the guidelines, policies and regulations for the construction and management of national key laboratories; formulate overall development plans and plans for Sichuan Provincial Key Laboratories; be responsible for the identification, reorganization, merger and cancellation of provincial key laboratories, and support and guide provincial key laboratories Construction and operation management, organization and implementation of the assessment and evaluation of provincial key laboratories, etc.
Article 5: Relevant departments at the provincial level or city and state science and technology management departments are the administrative departments of provincial key laboratories. They are responsible for guiding the operation and management of their own departments and laboratories of this system, and organizing and implementing laboratory construction. , and provide necessary support.
Article 6 The supporting unit of the Provincial Key Laboratory shall be specifically responsible for the construction and daily operation of the laboratory, provide key human, financial and material support to the Provincial Key Laboratory, and provide construction and opening operation funds as well as laboratory Build the necessary supporting conditions and logistical support; be responsible for appointing the director of the provincial key laboratory, the director of the academic committee and the members of the academic committee; coordinate and solve major problems in the development of the provincial key laboratory, and cooperate with the provincial science and technology department and administrative departments to do a good job in the laboratory Assessment, evaluation and other work.
Chapter 3 Establishment and Construction
Article 7 Provincial key laboratories should meet the following conditions:
1. Generally, they have been in operation and open to the public for 2 years The above department (local) key laboratories.
2. The research field is in line with the national and provincial science and technology development strategic goals, has obvious research advantages and regional characteristics, has outstanding achievements in scientific research activities, has international and domestic leading scientific research results, and has the ability to undertake major national and provincial projects. Scientific research projects and the ability to carry out extensive international and domestic academic exchanges and cooperation.
3. Have academic leaders with high academic standards, rigorous styles, and strong organizational skills, and a scientific research talent team with excellent scientific research performance, unity and collaboration, and reasonable structure, and have the ability to cultivate high-level scientific and technological talents.
4. Have good infrastructure conditions such as experimental sites, instruments and equipment, and have stable management and technical personnel teams and a sound management system.
5. The supporting unit and its administrative department can provide the laboratory with corresponding working funds, logistical support, academic activities and other supporting conditions to ensure the normal operation of the laboratory.
6. To establish a provincial key laboratory, an enterprise should also meet the following conditions:
Relying on the enterprise's strong comprehensive scientific and technological strength, mastering the core technology of the industry and owning independent intellectual property rights, it is in its own position. Leading position in the field.
Relying on the enterprise's large investment in science and technology, the proportion of annual R&D investment in annual sales revenue in the past three years is generally not less than 3.
Article 8 Provincial Key Laboratory Establishment Procedures:
1. The Provincial Department of Science and Technology shall formulate and issue the "Sichuan Provincial Key Laboratory" in accordance with the economic, social and scientific and technological development needs of the country and Sichuan Province. Laboratory Construction Guidelines" (hereinafter referred to as the "Guidelines"), guides laboratory application and construction.
2. The applicant should carefully fill out the "Sichuan Provincial Key Laboratory Feasibility Study Report Application" in accordance with the requirements of the "Guide", submit it to the administrative department for preliminary review and then recommend it to the Provincial Department of Science and Technology. Central units in Sichuan can apply directly to the Provincial Department of Science and Technology. Institutions without competent authorities can apply to the provincial science and technology department through the science and technology management department of the city or state where they are located.
3. The Provincial Department of Science and Technology will conduct a preliminary review of the "Application for Feasibility Study Report of Sichuan Provincial Key Laboratory" and organize expert review.
4. After passing the review, the applicant shall fill in the "Sichuan Provincial Key Laboratory Construction Plan Task Statement", and after preliminary review and approval by the competent department, submit it to the Provincial Department of Science and Technology for approval of the project.
Chapter 4 Operation and Management
Article 9 Provincial key laboratories shall implement the laboratory director under the leadership of the relying unit in accordance with the operating mechanism of "openness, mobility, jointness and competition" Accountability. The laboratory director is responsible for the scientific research, personnel recruitment, talent training and daily management of the laboratory. The laboratory director is recommended by the supporting unit, and with the approval of the competent department, the laboratory director is submitted to the Provincial Department of Science and Technology for approval. The laboratory director should be a high-level academic and subject leader in the field, with strong organizational management and coordination capabilities. The laboratory director should generally be no more than 60 years old, and generally work in the laboratory for no less than 8 months per year. The term of the laboratory director is 5 years and may serve continuously.
Article 10 The Academic Committee is the academic guidance agency of the Provincial Key Laboratory. Its main tasks are to study and determine the goals, tasks and research directions of the Provincial Key Laboratory, and to review the annual scientific research work plan, arrangements for major academic activities, Open research topics and other matters. The academic committee is generally composed of personnel with senior professional and technical positions, mainly experts representing the advanced academic level in this field in the province, and absorbs well-known experts at home and abroad, with the number not exceeding 13. Among them, the academic committee members of the supporting unit shall not exceed one-third of the total number, and the young and middle-aged academic committee members shall not be less than one-third. The term of academic committee members is 5 years and can be served continuously. Members are hired by the host unit and reported to its competent department for filing.
Article 11 The provincial key laboratory is composed of fixed personnel and floating personnel. According to the needs of operation and development, capable academic leaders, scientific research business backbones and management personnel should be retained, and other personnel should be hired as needed.
Article 12 The Provincial Key Laboratory shall formulate specific measures and methods for talent training and research team building, increase talent training through various methods, and absorb and stabilize high-level research teams.
Article 13 Provincial key laboratories must continuously improve and perfect the laboratory operation mechanism and promote the construction and development of the laboratory. Qualified provincial key laboratories should establish director funds.
Article 14 The Provincial Key Laboratory shall increase its openness to domestic and foreign countries, and actively carry out various forms of industry-university-research cooperation and domestic and foreign bilateral and multilateral scientific and technological cooperation and cooperation based on the principle of equality and mutual benefit. comminicate. Laboratory instruments, equipment, literature information, etc. should be opened to the public and become an open and public experimental research platform.
Article 15 Provincial key laboratories should establish and improve regulatory management systems and strengthen intellectual property protection. The research results completed by the laboratory, including monographs, papers, software, databases, etc., shall bear the name of the laboratory approved by the Provincial Department of Science and Technology. Patent applications, transfer of technological achievements, and application for awards shall be handled in accordance with relevant national regulations.
Article 16 For provincial key laboratories jointly established by multiple parties (including jointly established with domestic and foreign partners), the supporting unit and relevant units shall discuss their respective responsibilities and rights in establishment and operation. Negotiate and submit the agreement and other materials to the Provincial Department of Science and Technology.
Article 17 If it is really necessary to change the name of the laboratory or change the research direction due to the development of the laboratory, or to adjust, reorganize or integrate the laboratory, the research work before the change must be done, and the laboratory shall The director submits a written report, which is reviewed by the academic committee and relevant subject experts, and submitted to the host unit for approval by its competent department before being submitted to the Provincial Department of Science and Technology for approval.
Article 18 The Provincial Key Laboratory shall conduct an annual operation summary and work plan for the next year, and submit the "Sichuan Provincial Key Laboratory Annual Report" to the Provincial Department of Science and Technology in March of the following year. Provincial key laboratories that fail to submit materials as required for two consecutive years will be deemed to have automatically given up their key laboratory qualifications.
Chapter 5 Assessment and Evaluation
Article 19 The supporting unit shall conduct an annual assessment of the work of the provincial key laboratory every year, and the assessment results shall be reported to its competent department and the Provincial Department of Science and Technology for record.
Article 20: Provincial key laboratories implement an evaluation system. The Provincial Department of Science and Technology, together with relevant units, will evaluate provincial key laboratories that have been in operation for more than three years. The evaluation work is carried out in line with the principles of "relying on experts, promoting democracy, seeking truth from facts, being fair and reasonable". The "Sichuan Provincial Key Laboratory Evaluation Rules" will be released separately.
Article 21 The Provincial Department of Science and Technology, in accordance with the principle of survival of the fittest, will further increase support for provincial key laboratories evaluated as outstanding in terms of projects and talent training, and give priority to recommending applications for national key laboratories ; Those with poor management and poor performance will be required to make corrections within a time limit; those that fail two consecutive evaluations will have their title of provincial key laboratory revoked.
Chapter 6 Related Policies
Article 22: Some necessary imported instruments and equipment, prototype samples, experimental materials, and reagents required by provincial key laboratories shall be reported to the province by the supporting unit After review by the Department of Science and Technology, it will be submitted to the customs for relevant tariff reduction and exemption procedures.
Article 23 The Provincial Department of Science and Technology will provide key support and preference to the science and technology plan projects applied by the provincial key laboratories, and give priority to the national science and technology plans applied by them.
Article 24 The special funds for the construction of Sichuan Province’s basic science and technology platform will be given to provincial key laboratories that meet the project establishment requirements.
Article 25: Provincial key laboratories that introduce outstanding talents at home and abroad and meet the funding conditions of the Sichuan Provincial Youth Fund will enjoy the same priority policy. Priority will be given to recommending outstanding young and middle-aged scientific and technical personnel in provincial key laboratories to participate in the selection of provincial academic leaders, and professional and technical personnel in provincial key laboratories will be given preferential treatment in terms of professional title evaluation, promotion, further study, and degree pursuit.
Article 26 Provincial key laboratory personnel who wish to go abroad to carry out international scientific and technological cooperation and exchanges may directly report to the Provincial Department of Science and Technology for approval.
Chapter 7 Supplementary Provisions
Article 27 The provincial key laboratories shall be uniformly named “×× Key Laboratory of Sichuan Province”, and their English names shall be “×× Key Laboratory of Sichuan” Province".
Article 28 Relevant provincial departments, city and state science and technology management departments may formulate corresponding operation and management measures or "Implementation Rules" based on these measures. Laboratories established by provincial and ministerial departments are regarded as provincial-level laboratory management, and there is no supporting unit of the administrative department. Management work can be strengthened by referring to these measures.
Article 29: The Department of Science and Technology of Sichuan Province is responsible for the interpretation of these Measures and will be implemented from the date of promulgation.
