In order to further reduce the social burden and promote the protection of patent creation, according to the spirit of the Notice of the National Development and Reform Commission of the Ministry of Finance on Policies to Stop Collecting, Exempting and Adjusting Some Administrative Fees (Caishui [20 1 8] No.37), China National Intellectual Property Administration stopped collecting and adjusting some patent fees from August12065438. The announcement is as follows: Announcement No.272 on suspending and adjusting some patent fees. 1. The patent application fee (international part) includes the patent registration fee, the announcement printing fee, the specification change fee (the change of the entrustment relationship between the patent agency and the agent) and the transmission fee when the patent fee (domestic part) is suspended. The above fees shall be paid in accordance with the current regulations before the expiration date of July 3 1 and 20 18 (inclusive). 2. For patent applicants or patentees who meet the relevant conditions in the Measures for Reduction and Payment of Patent Fees (Cai Shui [2016] No.78), the annual reduction and payment period of patent fees shall be extended from 6 years in the year of authorization to 10 years. For patents that have been authorized to reduce fees before July 3, 20 18, the following treatment shall be made: within 6 years from the year of authorization, the annual fee reduction period shall be extended to 10; If it is authorized for 7-9 years from the current year, the annual fee will continue to be reduced from the following year until 10 year; The annual fee will not be reduced if it exceeds 10 years and 10 years from the authorized year. 3. An application for a patent for invention that has entered the stage of substantive examination may request a refund of 50% of the fee for substantive examination of the patent application before the expiration of the reply period of the first notice of examination opinions (except those that have been submitted).
