How to maintain American trademarks after registration?

I. Submission of evidence

The United States attaches great importance to the actual use of registered trademarks, so it is necessary to submit evidence of trademark use to the US Patent and Trademark Office within 5-6 years from the date of successful registration of American trademarks and every 65,438+00 years after registration. If the trademark is overdue (grace period is 6 months), a certain fine will be paid, and those goods that have not been put into use need to be deleted.

Second, the trademark oath

According to the American Trademark Law, in Article 8 of the American Trademark Law, during the fifth and sixth years after the trademark registration, the trademark registrant must submit an affidavit signed in Article 8 to the US Patent and Trademark Office, swearing that the registered trademark will be used on all trademarks and services approved by the registration within five years after the trademark registration. If you don't use it within five years, you will face the risk of being revoked. After the American trademark is registered, an oath is required under the following circumstances:

1. Intentional use of American trademarks requires an oath.

You need to take an oath after 5-6 years of American trademark registration.

3. Article 15 of the American Trademark Law is "indisputable" and requires an oath.

4. The use of registered trademarks in the United States requires an oath before renewal.

(Note: The starting date of applications based on intentional use, applications based on actual use and applications based on domestic registration is the registration date, and the starting date specified based on Madrid trademark registration is the non-Madrid international registration date).

Third, trademark renewal.

Trademark renewal in the United States is the same as that in China. It is renewed once every 10, and the period of validity after renewal is 10 (the period of validity of trademark registration and renewal before198917 is 20 years). The time for submitting renewal is from half a year before the expiration of registration to three months after the expiration of registration. If the renewal is submitted within the three-month extension period after the registration expires, a fine will be paid.

America attaches great importance to the use of trademarks. The evidence and oath of a trademark also affect the subsequent use of the trademark and whether it can continue to have the right to use it. If the enterprise misses the time to maintain the trademark, it may lose the exclusive right to use the trademark.
