Regulations of Tianjin Municipality on the Management of Rural Collective Assets (revised on 20 10)

Chapter I General Provisions Article 1 In order to strengthen the management of rural collective assets, protect the legitimate rights and interests of owners of collective assets, and promote the development of rural collective economy, these Regulations are formulated in accordance with relevant state laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the collective asset management of village-level collective economic organizations. Article 3 All members of the village collective economic organization are the owners of the village collective assets, and they have the right to possess, use, benefit and dispose of the collective assets according to law.

The village collective economic organization management institution shall manage collective assets on behalf of all members of the collective economic organization according to law. In villages without collective economic organizations and management institutions, the villagers' committees shall exercise the functions of collective asset management. Article 4 The Municipal Rural Work Committee is the administrative department in charge of the management of rural collective assets, and is responsible for guiding and supervising the management of rural collective assets in the whole city.

The administrative departments of rural collective assets management of the people's governments of districts and counties with agriculture and the people's governments of townships and towns are responsible for the guidance and supervision of rural collective assets management within their respective administrative areas. Article 5 The administrative department in charge of rural collective assets management shall perform the following duties:

(a) the implementation of laws, regulations and rules on the management of rural collective assets;

(two) to guide the village collective economic organizations to establish and improve the collective asset management institutions;

(three) to guide and supervise the village collective asset management institutions to manage collective assets according to law;

(four) to guide and supervise the village collective economic organizations to establish and improve the management system of collective assets registration, statistics, evaluation and auditing;

(five) to be responsible for the work guidance and business training of the democratic financial supervision group;

(six) other duties as prescribed by laws and regulations. Chapter II Ownership of Collective Assets Article 6 Village collective assets include the following scope:

(1) Natural resources such as land, forests, mountains, grasslands, water surfaces and beaches that are legally owned by village collectives;

(two) buildings, roads, agricultural machinery, mechanical and electrical equipment, vehicles, communication tools, livestock, trees, irrigation and water conservancy facilities and educational, scientific, cultural, health and sports facilities owned by the village collective economic organizations;

(three) in the village collective economic organizations to invest in enterprises, according to the investment share of the assets and assets appreciation rights;

(four) subsidies, subsidies, tax relief given by the government to the village collective economic organizations, as well as donations and other property given by state organs, social organizations, enterprises and institutions, other organizations and individuals to the village collective economic organizations;

(five) all the cash, deposits and securities of the village collective economic organizations;

(6) Intangible assets such as trademark rights, patents and copyrights owned by village collective economic organizations;

(seven) other assets owned by the village collective economic organizations as stipulated by laws and regulations. Seventh village collective assets are protected by law.

It is forbidden for any unit or individual to plunder, occupy, damage, misappropriate, privately divide, squander, transfer or otherwise illegally occupy village collective assets.

Members of the village collective economic organizations and management institutions have the right to stop the illegal acts mentioned in the preceding paragraph. Eighth village collective assets ownership disputes, the parties can be resolved through consultation. If negotiation fails, if they belong to the same township or town, they can be mediated by the people's government of the township or town where they are located; Belong to the same district, county or township, or township mediation fails to reach an agreement, it can be handled by the administrative department of rural collective assets management of the district or county; Cross-regional, county or district-county mediation fails to reach an agreement, which can be handled by the administrative department of rural collective assets management. The parties may also bring a lawsuit directly to the people's court.

During the settlement of the dispute over the ownership of village collective assets, both parties to the dispute shall not change the property rights of collective assets. Chapter III Management of Collective Assets Article 9 The management institutions of village collective economic organizations shall perform the following duties:

(a) the implementation of laws, regulations and rules on the management of rural collective assets;

(two) the implementation of the articles of association, resolutions and decisions of collective economic organizations;

(three) responsible for the daily management of collective assets;

(four) to formulate a collective asset management system to ensure the preservation and appreciation of collective assets;

(five) to send personnel to participate in the management of investment enterprises;

(six) to sign contracts for contracting, leasing and using collective assets with operators and users according to law;

(seven) regularly report the management of collective assets;

(eight) to be responsible for organizing the collective assets evaluation, and regularly auditing the operators and users as well as the outgoing audit. Tenth village collective economic organizations and management institutions shall manage and operate collective assets in accordance with the principles of paid use and preservation and appreciation.

Village collective economic organizations and management institutions shall determine the operators and users of collective assets in an open and fair way. Conditional, you can use bidding, bidding, unless otherwise stipulated by laws and regulations.

To operate or use collective assets, a contract shall be signed with the village collective economic organization and management institution according to law, and the rights and obligations shall be enjoyed in accordance with the contract.

Members of the village collective economic organizations and management institutions shall not use their powers to drive down prices and lease collective assets at low prices.

Village collective economic organizations and management institutions shall respect the operational autonomy of their investment enterprises and collective asset operators.
