Notice on Implementing Subsidies for Labor Arbitrators in Handling Cases

Local and municipal labor bureaus:

According to Article 18 of the Notice of the Ministry of Labor on Printing and Distributing the Organizational Rules of the Labor Dispute Arbitration Committee (No.300 issued by the Ministry of Labor [1993]), "Arbitrators shall be subsidized by the Arbitration Committee, and the subsidy standards shall be determined by provinces, autonomous regions and municipalities directly under the Central Government" and1No.48 issued by the provincial people's government on June 20, 1996, "The implementation of labor dispute handling in enterprises in Jiangxi Province" The subsidy standard shall be implemented with reference to the provisions of the local people's court on the implementation of the post allowance standard for police officers. In order to implement the spirit of the above documents, combined with the actual situation in our province, the following opinions are put forward.

I. Subsidy standards

1. Full-time labor arbitrators shall combine fixed case handling subsidies with case subsidies. 30 yuan will be given a fixed monthly subsidy for handling cases, and 30 yuan will be given a separate subsidy for each case.

2. Part-time labor arbitrators shall subsidize 30 yuan in each case.

Second, the scope and conditions of enjoying subsidies

1, must be a full-time and part-time arbitrator certificate at or above the provincial level. In the post of labor arbitration, there are full-time and part-time labor arbitrators who participate in the trial of cases.

2. The subsidy for each case, from filing, trial to closing, must have a standard basis. Unfinished cases, or sporadic participation in handling cases, will not be subsidized.

3. The subsidy for each case shall be calculated on a case-by-case basis, and no additional subsidy standard shall be added on the grounds of long handling time.

Three, should establish the registration, approval and collection procedures for handling subsidies, so as to be realistic and well documented.

Four, handling subsidies from the labor arbitration fees and related funds charged.

I am a labor dispute worker in a city in Anhui Province. Engaged in labor arbitration for more than two years.

After engaging in labor dispute arbitration, I deeply feel that the responsibility of labor dispute arbitration is great, and the complexity of cases and the number of cases accepted are increasing year by year (even reaching 200 cases per year in areas with more cases). Labor dispute arbitration has become an important way for workers to safeguard their rights and enter the field of vision of labor groups.

However, as labor dispute arbitrators, the time and energy we need to pay can not be covered by a single award. We need to spend a lot of time to identify the authenticity of the evidence, to understand the development of the case, and sometimes even to endure the criticism of some lawless elements or enterprises. The majority of labor dispute arbitrators work hard on the front line!

But just behind these sorrows, most areas in Anhui Province have no funds for labor arbitration, and arbitrators have funds for handling cases! Better areas also suffer from the lack of documents and can not get the benefits that arbitrators should have. At present, the basis for our expansion is the notice of the Labor Arbitration Commission1998 (No.2) on the implementation of case handling subsidies in the Labor Arbitration Institute. The sole arbitrator and the presiding arbitrator shall be 40-60 yuan per case, and the ordinary arbitrator and the clerk shall be 20-40 yuan per case. In 20 17, when the economy took off and prices soared, our arbitrators still held the subsidy standard for handling cases in 1998, which made us case handlers who served the front line of enterprises and sought benefits for the masses feel chilling.

Attached are the subsidy documents issued by the provinces as follows:

20 12 Ningxia promulgated the Measures for the Administration of Subsidies for Arbitrators of Labor and Personnel Disputes, and subsidized 200 yuan for each case; If the number of people involved exceeds 9, it shall be tried by a collegial panel. In cases tried by the collegial panel, if the number of people involved is less than 10, 400 yuan will be subsidized for each case; Involving more than 10, less than 50600 yuan, each subsidy; Involving more than 50 people (inclusive) dissatisfied with 100, each case will be subsidized by 800 yuan; If the number of people involved exceeds 100 (inclusive), the subsidy for each case will increase by 100 yuan for each additional person, and the maximum subsidy for each case will not exceed 2,000 yuan.

In 20 17, Hainan issued "Qiongrenshefa [20 17] No.351"as the sole or chief arbitrator, and the subsidy was paid at 150 yuan/person/piece; As an arbitrator of the collegial panel, subsidies shall be paid according to 50 yuan/person/piece; Part-time arbitrators will add 300 yuan to each case on this basis.

Please pay attention to the provincial leaders and issue documents as soon as possible to solve the subsidy problem of the majority of labor arbitrators.
