Paragraph 1 of Article 2 of the Supreme People's Court's Interpretation on the Application of the Civil Procedure Law of People's Republic of China (PRC) stipulates that patent dispute cases shall be under the jurisdiction of intellectual property courts, intermediate people's courts and grassroots people's courts determined by the Supreme People's Court. A lawsuit brought for patent infringement shall be under the jurisdiction of the people's court in the place where the infringement occurred or the defendant's domicile. The people's court of domicile is the intermediate people's court and the basic people's court determined by the Supreme People's Court.
