Patent review usually takes three months. According to relevant legal provisions, if a patent applicant is dissatisfied with the decision of the Patent Administration Department of the State Council to reject the application within three months from the date of receipt of the notice, he may request a review from the Patent Administration Department of the State Council. If the patent administration department of the State Council decides to review the case, it shall make a decision and notify the parties concerned.

Article 41 of the "Patent Law" If a patent applicant is dissatisfied with the decision of the patent administration department of the State Council to reject the application, he may file a lawsuit within three days from the date of receipt of the notice.
