(1) shall not violate national laws and social ethics, and shall not interfere with public interests, which is the prerequisite for granting patent rights. Inventions and creations that violate the laws of the state mentioned in Article 5 of the Patent Law do not include inventions and creations actually prohibited by the laws of the state.
(2) Compliance with the provisions of the patent legal system is the basis for granting patent rights.
⑶ Patentability (novelty, creativity and practicality) is the fundamental condition for passing the patent authorization examination.
