Can I apply for a patent to treat this disease?

The current Patent Law of People's Republic of China (PRC) stipulates that there is no patent for the diagnosis and treatment of diseases. However, the patent examination guide of this regulation points out that the instruments or devices used to implement disease diagnosis and treatment methods, and the substances or materials used for disease diagnosis and treatment methods belong to the objects that can be granted patent rights. That is, when the innovative technical scheme is a disease diagnosis method or treatment method, although the disease diagnosis method or treatment method itself cannot be patented, the instrument or device for implementing the disease diagnosis and treatment method and the substance or material for the disease diagnosis and treatment method can be patented. It should be pointed out that although the method of using drugs to treat diseases cannot be patented, the drugs themselves can be patented.
