Registration Conditions

Chinese citizens who support the Constitution of the People’s Republic of China and meet the following conditions can register for the National Patent agent qualification examination:

1. Over 18 years old, with full capacity for civil conduct;

2. Graduated from a college majoring in science and engineering or having equivalent academic qualifications;

3. Familiar with patent law and related legal knowledge;

4. Have engaged in scientific and technical work or legal work for more than two years.

Graduation from science and engineering majors in colleges and universities refers to obtaining a nationally recognized college degree or above in science and engineering and obtaining a diploma.

Examination paper subjects

The examination includes patent legal knowledge[1] (total score of 150 points), relevant legal knowledge (total score of 100 points) and patent agency practice (total score of 100 points) 150 points) three examination subjects.

The exam is conducted in a closed-book format. The two subjects of patent legal knowledge and related legal knowledge adopt the method of filling in machine-readable answer sheets, and the patent agency practice subject adopts the method of essay answering and practical writing.

Examination Admission

The sum of patent legal knowledge and related legal knowledge (called the "Legal Knowledge" part) is used to determine a score line and patent agency practice (called the "Agency Practice" part) The admission method is to determine one score line separately and pass the two qualified score lines on a selective basis. Each year, the Patent Agent Assessment Committee determines the passing scores for the legal knowledge part and the agency practice part based on the actual needs of patent work and the difficulty of the test questions that year.

Article 1

Article 2

The patent agent qualification examination adopts the national unified examination method and is held once a year.

Article 3

The patent agent qualification examination includes the following examination subjects:

(1) Basic legal knowledge related to patents;

(2) Patent application document writing;

(3) Patent application procedures, approval procedures and literature search;

(4) Patent approval standards, review and invalidation.

The Patent Agent Qualification Examination shall be conducted in the form of closed-book written examination.

Article 4

The Patent Agent Qualification Examination shall be organized by the Patent Agent Assessment Committee.

The Patent Agent Assessment Committee is composed of relevant personnel from the State Intellectual Property Office, relevant departments of the State Council, All-China Patent Agents Association, and representatives of patent agents. The leader of the State Intellectual Property Office serves as the committee director.

The office of the Patent Agent Assessment Committee is located in the State Intellectual Property Office and is responsible for all specific work of the patent agent qualification examination.

Article 5

The Patent Agent Examination Committee shall issue a notice six months before holding the patent agent qualification examination, announcing the examination center city, examination time and other matters.

The patent agent qualification examination is unified by the Patent Agent Assessment Committee, and the scope of the questions is based on the "Patent Agent Qualification Examination Outline" formulated and published by the Patent Agent Assessment Committee.

Article 6

The intellectual property offices of the provinces, autonomous regions, and municipalities where each examination center city is located shall establish a leading group for the patent agent qualification examination to accept applications, review the qualifications of applicants, and Set up examination rooms, organize examinations, etc.

Article 7

Persons who sign up to take the patent agent qualification examination shall meet the conditions stipulated in Article 15 of the "Patent Agency Regulations".

Those who have any of the following circumstances are not allowed to take the patent agent qualification examination:

(1) Those who have received criminal punishment for intentional crimes;

(2) Being revoked as a patent agent;

(3) Being disqualified from the examination for less than three years due to the circumstances specified in Article 12 of these Measures.

Article 8

Persons who sign up to take the patent agent qualification examination shall pay the examination registration fee in accordance with the standards set by the price management department of the State Council in conjunction with the State Intellectual Property Office.

Article 9

Regional intellectual property offices, the All-China Patent Agents Association and relevant institutions and organizations may hold patent agent qualification examination training courses, but the examination shall not be compulsorily required When registrants participate in training, they shall not be forced to purchase designated teaching materials or other exam-aid materials.

Article 10

Personnel who participate in the question setting, review and organization management of the Patent Agent Qualification Examination are not allowed to participate in the examination, and the question setting and review personnel are not allowed to engage in any work related to the Patent Agent Qualification Examination. Article 11

If a person taking the patent agent qualification examination violates the rules of the examination room, the invigilator shall stop him and issue a warning.

Article 12

Article 14

The passing score for the Patent Agent Qualification Examination shall be determined by the Patent Agent Assessment Committee and announced by the Office of the Patent Agent Assessment Committee.

Article 15

If a person who takes the patent agent qualification examination reaches the published passing score for the patent agent qualification examination, the State Intellectual Property Office will issue a "Patent Agent Qualification Certificate" 》.

Article 16

The specific examination rules regarding the registration, examination room setting, examination paper transportation and storage, examination rules, invigilation, marking, and score verification for the patent agent qualification examination will be discussed separately. formulated and published.

Article 17

The staff of the Patent Agent Qualification Examination shall strictly follow the requirements of these Measures and the examination rules to carry out various tasks related to the Patent Agent Qualification Examination. . Staff involved in setting questions, transporting and keeping test papers, and invigilating exams must strictly abide by the confidentiality system; staff involved in grading must be conscientious, responsible, fair, and impartial.

If any staff member of the patent agent qualification examination neglects his duty, abuses his power, or engages in malpractice for personal gain, he shall be held accountable in accordance with the provisions of Article 67 of the Patent Law of the People's Republic of China.

Article 18

The State Intellectual Property Office is responsible for the interpretation of these Measures.

These Measures shall come into effect on April 1, 2004.
