Measures for the Administration of Private Sci-tech Enterprises in Fujian Province

Article 1 In order to mobilize the enthusiasm of scientific and technological personnel, promote the combination of science and technology with economy, promote the development of private scientific and technological enterprises, and safeguard their legitimate rights and interests, these Measures are formulated in accordance with relevant national laws and regulations and combined with the actual situation of this province. Article 2 People's governments at or above the county level shall actively take effective measures to encourage, guide and support the healthy development of private scientific and technological enterprises. Article 3 The term "private scientific and technological enterprises" as mentioned in these Measures refers to economic entities that are mainly engaged in scientific research, production and business activities such as technology development, technology transfer, technical consultation, technical service and technical training on the principle of voluntary combination, self-financing and self-financing. Article 4 The types of private scientific and technological enterprises are:

(1) State-owned private scientific and technological enterprises;

(2) Science and technology enterprises under collective ownership;

(3) Private technology enterprises (including private technology enterprises, partnership technology enterprises and individual technology enterprises with legal personality);

(4) Private technology enterprises (including private technology enterprises, partnership technology enterprises and individual technology enterprises with legal personality);

(five) the implementation of joint-stock cooperative science and technology enterprises (including limited liability companies and joint stock limited companies);

(6) Sino-foreign joint ventures, Sino-foreign cooperation and wholly foreign-owned technology enterprises. Fifth to encourage and support the following people to set up private technology enterprises:

(1) On-the-job scientific and technical personnel approved by enterprises and institutions;

(2) Persons with professional knowledge of science and technology who have resigned or resigned with the approval of state organs;

(3) Returned overseas students;

(four) other personnel with technical expertise. Sixth to encourage and support the transformation mechanism of state-owned scientific research institutes, universities, large and medium-sized enterprises and other economic organizations, and establish various forms of private scientific and technological enterprises.

Encourage and support scientific and technical personnel of institutions of higher learning and research institutes to work in private scientific and technological enterprises with the approval of their units. Article 7 The administrative departments of science and technology of people's governments at all levels shall be responsible for the guidance, management and service of private scientific and technological enterprises, and their duties are:

(a) to guide private scientific and technological enterprises to implement the relevant national development guidelines, policies, laws and regulations, and to carry out supervision and inspection;

(two) to formulate the overall development plan, policies and measures of private science and technology enterprises, and guide the implementation of various science and technology plans undertaken by private science and technology enterprises;

(three) responsible for the identification and registration of private technology enterprises;

(four) according to the relevant provisions, responsible for the evaluation of the achievements of private scientific and technological enterprises;

(five) commend and reward units and individuals that have made outstanding contributions to the development of private technology enterprises;

(six) to organize the evaluation of the titles of scientific and technological personnel in private scientific and technological enterprises;

(seven) responsible for the comprehensive statistics of private science and technology enterprises, and participate in the organization of personnel training, information consulting and other related services. Eighth industry and commerce, taxation, finance, personnel, foreign affairs, public security, planning, economy and trade, labor, education and other relevant departments, according to the prescribed division of responsibilities, do a good job in supporting and managing private technology enterprises. Article 9 Private technology enterprises shall go through the formalities of establishment, alteration and termination of registration with the administrative department for industry and commerce according to law. Tenth to apply for the identification of private technology enterprises, apply to the local administrative department of science and technology at or above the county level for the qualification of private technology enterprises and issue a certificate of technology enterprises.

The administrative department of science and technology shall solicit the opinions of the relevant administrative departments when handling the qualification procedures of private technology enterprises. Eleventh private technology enterprises must meet the following conditions:

(a) in line with the business scope of private technology enterprises;

(two) there are legitimate patents or scientific and technological achievements, new technology products, non-patented technology;

(three) full-time employees (excluding production workers) have more than 25% technical personnel with junior college or intermediate titles, and full-time and part-time employees should have non-employment certificates or unit consent certificates;

(4) Having working conditions, fixed office space and registered capital suitable for the business scope, and intellectual property rights can be converted into registered capital after legal evaluation;

(five) the proportion of annual technical income to total income is not less than 20%. Twelfth private science and technology enterprises merger, change, shall apply to the administrative department of science and technology at or above the county level for the identification of private science and technology enterprises. Thirteenth private scientific and technological enterprises in the transfer of technological achievements, technical training, technical consulting, technical services and technology development in various industries to obtain technical service income, by the administrative department of science and technology audit, the tax authorities in accordance with the provisions of tax incentives for scientific research institutions. The tax reduction and exemption part shall be used as the development fund of the enterprise for scientific research, technological development and expanded reproduction, and shall not be used for other purposes. Article 14 After the private technology enterprises are officially put into production, if the annual tax payment is more than 300,000 yuan, the management system is sound, and the business backbone belongs to the scientific and technological personnel outside Fujian, they can apply for household registration or enjoy other preferential treatment at their business locations after being audited by the administrative department of science and technology and reported to the personnel department for approval. There are major scientific and technological achievements, according to the provisions of priority for households. Article 15 Private scientific and technological enterprises that meet the corresponding requirements of the state and the province for high-tech enterprises, pilot projects, technology markets and technology exports shall enjoy the same preferential treatment, and private scientific and technological enterprises shall enjoy the same treatment as scientific research institutions owned by the whole people in terms of technology loans, achievement evaluation, professional and technical post evaluation and employment, etc.

Private scientific and technological enterprises can apply for scientific research projects and operations planned by the state, and the state will share the results and benefits according to the corresponding investment ratio.
