1. If the patent fee is paid in person to the Patent Office or its agency, the payment date shall be the payment date;
2. If payment is made by postal remittance, the postmark date of postal remittance shall be the date of payment;
3. If payment is made by bank remittance, the actual remittance date of the bank shall be the payment date;
4. If the fee is paid directly to the patent administrative department of the State Council, the payment date shall be the payment date;
5. If it takes more than 15 days from the date of remittance to the date of receipt by the patent administration department in the State Council, the date of receipt by the patent administration department in the State Council shall be the payment date, except that the certificate is issued by the post office or bank.
How much is the patent application fee?
When applying for a patent and going through other formalities with the patent administration department of the State Council, the following fees shall be paid:
1, application fee, application surcharge, publication and printing fee and priority claim fee;
2, the application for a patent for invention substantive examination fee, review fee;
3. Patent registration fee, announcement printing fee and annual fee;
4. The right to resume the request fee and extend the request fee;
5. Describe the project change fee, patent evaluation report request fee and invalidation request fee.
The payment standards of the fees listed in the preceding paragraph shall be stipulated by the price management department of the State Council and the financial department in conjunction with the patent administration department of the State Council.
Legal basis: Article 94 of the Detailed Rules for the Implementation of the Patent Law of People's Republic of China (PRC) (revised 20 10).
The fees specified in the Patent Law and these Detailed Rules may be paid directly to the patent administration department in the State Council, or by other means specified by the post office, bank or the patent administration department in the State Council.
If remittance is made by post office or bank, the correct application number or patent number and the name of the fee paid shall be indicated on the remittance slip sent to the patent administration department in the State Council. If it does not conform to the provisions of this paragraph, it shall be deemed that it has not gone through the payment formalities.
If the fee is paid directly to the patent administrative department of the State Council, the payment date shall be the payment date; If payment is made by post office remittance, the postmark date of post office remittance shall be the payment date; If payment is made by bank remittance, the actual remittance date of the bank shall be the payment date.
If the patent fee is overpaid, re-paid or wrongly paid, the party concerned may, within 3 years from the date of payment, request a refund from the patent administration department in the State Council, and the patent administration department in the State Council shall refund it.
