Article 4 People's governments at all levels must adhere to the policy of taking the public economy as the mainstay and the long-term and coordinated development of various economic components and the principle of fair competition, and encourage, guide and support the development of individual economies. Article 5 The legitimate business activities and legitimate rights and interests of individual industrial and commercial households are protected by state law, and no unit or individual may interfere or infringe. Chapter 2 Registration Article 6 Individual industrial and commercial households may operate in industry, handicrafts, construction, transportation, commerce, catering, service, repair and other industries, industries that are prohibited by laws, regulations and rules from being operated by individual industrial and commercial households or Projects excluded. Article 7 Individual industrial and commercial households may engage in business operations such as self-production and self-sales, agency purchasing and sales, retail, wholesale, wholesale and retail operations, processing of supplied materials, passenger transport services, freight services, valet storage and transportation, valet loading and unloading, repair services, consulting services, etc. In this way, it can contract, lease, or purchase state-owned enterprises and collective enterprises; it can operate jointly with other economic entities of an economic nature.
Individual industrial and commercial households can engage in border trade activities and do business abroad and set up enterprises; they can undertake processing of supplied materials, assembly of supplied parts, customization of supplied samples and compensation trade business. Article 8 Individual industrial and commercial households may operate individually or as a family. If the business is run by an individual, the entire personal property shall bear civil liability; if the business is run by a family, all the property of the family shall bear civil liability. Article 9 Individuals or families that apply to engage in individual industrial and commercial operations shall apply for registration with the industrial and commercial administrative authorities at the place of business with a written application and identity certificate, and may only operate after being approved by the industrial and commercial administrative authorities at the county level and receiving a business license.
If laws and regulations stipulate that operators need to meet specific conditions or need to be approved by the relevant administrative departments, they should submit the corresponding approval documents when applying for registration. Article 10 The administrative authority for industry and commerce shall, within 15 days from the date of receipt of the application, register those who meet the conditions and issue a business license; for those who do not meet the registration conditions, notify the applicant in writing and state the reasons.
The relevant administrative departments responsible for examining and approving the specific conditions and matters for the opening of individual industrial and commercial households shall review and approve the application within fifteen days from the date of receipt of the application, and issue approval documents to those who meet the conditions; If the conditions are met, the applicant will be notified in writing and the reasons will be stated. If laws and regulations otherwise stipulate the review and approval period, such provisions shall prevail. Article 11 Individual industrial and commercial households are not allowed to register and engage in business activities in the name of state-owned enterprises or collective enterprises. Agencies, groups, institutions, state-owned enterprises and collective enterprises shall not help individual industrial and commercial households register in the name of state-owned enterprises or collective enterprises. Article 12 The main items that individual industrial and commercial households should register are as follows: trade name, name and address of the operator, number of employees, amount of capital, form of composition, business scope, business method, and business location. Article 13 If an individual industrial and commercial household changes its trade name, operator's domicile, composition form, business scope, business method, or business location, it shall apply for change registration with the original industrial and commercial administrative authority of registration, and submit it to the original approving administrative department for record.
When an individual industrial and commercial household changes its operator, it must re-apply for registration. Article 14 When an individual industrial and commercial household goes out of business, it shall go through the closing procedures with the original industrial and commercial administrative agency where it was registered, surrender and cancel its business license, and submit it to the original approving administrative department for record. If the business ceases business voluntarily for more than six months, the business license shall be confiscated by the original registration administrative authority for industry and commerce.
Chapter 3 Rights and Obligations Article 15 Individual industrial and commercial households shall enjoy the following rights in business activities:
(1) To establish a trade name according to business needs, and the registered trade name shall enjoy exclusive rights within the prescribed scope;
(2) Operate independently in accordance with the law within the scope of approved registration;
(3) Hire helpers, recruit apprentices, and dismiss helpers and apprentices in accordance with the law;
( 4) Submit an application for change, suspension of business or suspension of business;
(5) Enter into, change or terminate a contract in accordance with the law;
(6) Apply to obtain patent rights and exclusive rights to registered trademarks in accordance with the law;
(7) Carry out advertising in accordance with relevant national regulations;
(8) Engraving business seals and contract seals with business licenses;
(9) Set commodity prices and service charging standards on your own, except for national fixed prices and national guided prices;
(10) Independently determine labor remuneration and income distribution in accordance with the law;

(12) Other rights granted by laws and regulations. Article 16 Individual industrial and commercial households have the right to apply for professional and technical titles. When assessing the professional and technical titles of individual industrial and commercial households, they should be treated equally with employees of state-owned enterprises and collective enterprises. Article 17 Except for items stipulated by laws, regulations and the people's government of the autonomous region, individual industrial and commercial households have the right to refuse fees, fines, and assessments from any unit or individual, and may appeal or report to the government or relevant departments, or file a lawsuit with the people's court .
