China citizens who meet the following conditions can sign up for the patent agent qualification examination:
1, with full capacity for civil conduct;
2. Obtain a college degree or above in science and engineering recognized by the state, and obtain a diploma or degree certificate.
China citizens and residents of Taiwan Province Province who are permanent residents of the Hong Kong Special Administrative Region and the Macao Special Administrative Region may register for the examination.
A patent agent refers to a person who has obtained the qualification to apply for a patent and handle other patent affairs on behalf of others. A patent agent should have certain practicing conditions. After examination and approval, China National Intellectual Property Administration will issue a patent agent qualification certificate, practice for one year, and put it on record through the patent agent management system.
The specific business of patent agents can be roughly divided into providing patent consultation, handling application procedures, maintaining patent validity, and representing litigation. Where the applicant entrusts a patent agency to apply for a patent to the Patent Office and handle other patent affairs, it shall also submit a power of attorney, indicating the authorization authority.
A patent agent is a person engaged in patent agency work, whose main business is:
1, providing patent application consultation;
2. Acting as an agent to write patent application documents, apply for patents, go through the formalities of examination and approval and all the formalities in post-examination affairs;
3. Acting as an agent for the examination of patent applications, revocation or invalidation of patent rights, or providing consultation on the above procedures;
4. Handling the transfer of patented technology, or providing patent technology consultation;
5. Other related patent affairs.
