In recent years, China National Intellectual Property Administration has strictly implemented the decision-making arrangements of the CPC Central Committee and the State Council on shortening the intellectual property review cycle, and successively issued policy documents such as Three-year Plan for the Reform of Trademark Registration Facilitation and Implementation Opinions on Mobilizing Overall Cadres and Workers to Win the Tough Battle of Improving Quality and Increasing Efficiency. By streamlining procedures, optimizing processes, enriching the power of review, strengthening information construction and other means, the intellectual property review cycle has been continuously compressed. During the "Thirteenth Five-Year Plan" period, the number of patent and trademark applications increased rapidly, but our review cycle was constantly compressed. The average examination time for trademark registration was reduced from 9 months to 4 months, for invention patents from 22 months to 20 months, and for high-value patents from 265,438+0 months to 65,438+04 months.
However, we also notice that the existing statistical indicators of trademark examination cycle are based on the announcement of preliminary examination results and cannot accurately reflect the overall time taken by applicants to obtain intellectual property rights. At present, in addition to the average trademark review cycle of four months, there is also a three-month statutory notice period for preliminary examination, as well as necessary working time for handling special circumstances, mailing paper materials, issuing registration notices, making and delivering certificates. Therefore, the average period of trademark registration is about 8-9 months. To this end, in the notice, we put forward the goal and task of shortening the trademark registration cycle to reflect the whole process of trademark registration, comprehensively popularizing electronic registration certificates, and making it clear that by the end of 20021,the trademark registration cycle will be shortened from 8 months to 7 months as a whole, further enhancing people's satisfaction and sense of acquisition.
In addition, in view of the long processing time of some follow-up businesses generally reflected by applicants, the Notice proposes that by the end of 20021,the average review period of trademark transfer review, objection review, rejection review and invalidation declaration will be reduced to 1.5 months, 12 months, 5.5 months and 9 months respectively. The average period of patent authorization announcement is reduced to about 3 weeks, which effectively reduces the time-consuming of the whole process of intellectual property authorization confirmation, and enhances the applicant's satisfaction and sense of acquisition of the reform of "simplifying administration and decentralization, strengthening supervision and improving services".
