Annex Measures for the Construction and Operation Management of Key Laboratories of Ministry of Land and Resources

Chapter I General Provisions

Article 1 In order to standardize and strengthen the construction and operation management of key laboratories of the Ministry of Land and Resources (hereinafter referred to as key laboratories) and promote the sustained and healthy development of key laboratories, these Measures are formulated with reference to the Measures for the Construction and Operation Management of State Key Laboratories.

Article 2 Key laboratories are scientific research entities built on the basis of land and resources system, geological exploration units, scientific research institutes, relevant institutions of higher learning and other legal entities with scientific and technological innovation capabilities (i.e. supporting units). They are an important part of the scientific and technological innovation system of land and resources, an innovation platform for high-level basic research and applied basic research in the field of land and resources, gathering and cultivating outstanding scientific and technological talents, carrying out high-level academic exchanges and possessing advanced scientific research equipment.

Article 3 Key laboratories shall, according to the needs of the country and the reform and development of land and resources, carry out scientific and technological innovation research and applied technology research in the field of land and resources, obtain innovative achievements with independent intellectual property rights, cultivate high-level scientific and technological talents, continuously improve their scientific and technological innovation capabilities, and make contributions to supporting and leading the development of land and resources.

Article 4 The Ministry of Land and Resources, the provincial competent department of land and resources, relevant directly affiliated units and supporting units shall build and manage key laboratories in accordance with the principles of scientific planning, rational division of labor, stable support and dynamic adjustment, and implement a separate planning and management mechanism with relatively independent human and financial resources and an operating mechanism of "openness, mobility, alliance and competition".

Article 5 Relevant scientific and technological projects, funds and special projects of the Ministry of Land and Resources shall be entrusted to qualified key laboratories in priority according to the principle of combining projects, bases and talents.

Chapter II Management Responsibilities

Article 6 The Ministry of Land and Resources is the competent department of key laboratories, the competent department of science and technology is responsible for centralized management, and relevant business departments provide business guidance and support. Relying on the existing institutions of relevant units to set up key laboratory offices to undertake and support related work matters. The main responsibilities of the competent department are:

(a) to implement the national guidelines and policies on the construction and management of key laboratories, formulate relevant management measures, and formulate and implement the development plan of key laboratories.

(2) Organizing the selection, acceptance, evaluation and examination of key laboratories, and examining and approving the establishment, adjustment and cancellation of key laboratories.

(3) Organizing and recommending qualified key laboratories to apply for the construction of State key laboratories, coordinating relevant work during the construction period, and guiding the construction and operation of key laboratories.

(four) to organize the investigation and statistics of the scientific research conditions, talents and achievements of key laboratories, and to establish the archives management system of key laboratories.

Seventh provinces (autonomous regions and municipalities) competent departments of land and resources shall undertake the management of subordinate units and related scientific research units, geological exploration units and key laboratories of related enterprises within their respective administrative areas; China Geological Survey and Armed Police Gold Command undertake the management of key laboratories of their subordinate units; Other directly affiliated units of the Ministry of Land and Resources undertake the construction and operation management of the key laboratory of this unit, and their main responsibilities are:

(a) support the construction and development of key laboratories, and incorporate them into the local (unit) key construction and development plans.

(two) to organize the preparation of key laboratory construction planning, coordinate and solve major problems in the construction and development of key laboratories, and guide the operation and management of key laboratories.

(three) to assist the evaluation, inspection and acceptance of key laboratories.

Eighth supporting units are the specific implementation and responsibility units of the construction and operation management of key laboratories, and their main responsibilities are:

(a) to organize the implementation of key laboratory construction, implement the relevant conditions for the construction of key laboratories, and provide necessary support for the operation of key laboratories.

(2) Giving key laboratories relatively independent personnel and financial rights, making separate plans in terms of resource allocation and management, and giving priority to supporting the development of key laboratories in terms of scientific research projects, equipment, scientific research sites, personnel training and funds.

(3) Organizing open recruitment and recommending the directors of key laboratories, recommending the directors of academic committees of key laboratories, and reporting to the competent authorities for approval and appointment; Appoint deputy directors of key laboratories and members of academic committees, and report to the competent authorities for the record.

(four) according to these measures, formulate detailed rules for the management of key laboratories, do a good job in the capacity and quality construction of key laboratories, conduct annual assessment of key laboratories, and cooperate with the competent authorities to do a good job in inspection, assessment and evaluation.

Chapter III Construction

Article 9 The Ministry of Land and Resources shall, according to the relevant planning and layout, select and build key laboratories in a planned and focused manner, and maintain a moderate construction scale.

Tenth key laboratory should have the following conditions:

(a) the research direction of the key laboratory conforms to the requirements of the relevant planning of the Ministry of Land and Resources, and the construction goal is clear.

(two) to apply for a new key laboratory, it should be the key laboratory of the relevant department, bureau or national or provincial key discipline construction, and has been running for more than 2 years.

(three) strong research strength, representative in this field, able to undertake major scientific research tasks of the state and departments.

(4) Having academic leaders in this research field and a high-level scientific research team with reasonable structure.

(five) there are good conditions for scientific research and experiments, and the personnel and scientific research sites are concentrated.

(six) a sound internal management system, a good scientific research and innovation culture and academic atmosphere.

(seven) supporting units should ensure the operation and opening of key laboratories and provide necessary support conditions.

Eleventh provinces (autonomous regions and municipalities) land and resources departments, China Geological Survey and other units directly under the Ministry of Land and Resources, and related universities under construction shall organize qualified units to fill in the application report for the construction of key laboratories of the Ministry of Land and Resources according to the notice of the competent departments and the construction requirements, and review the application report and make suggestions.

Article 12 The competent department shall organize formal examination and expert review of the application report. Organize experts to conduct on-site inspection and demonstration of laboratories that meet the reporting conditions. The expert group is generally composed of 7 or 9 technical experts and management experts in related fields.

Thirteenth approved laboratories must fill in the Key Laboratory Construction Plan of the Ministry of Land and Resources, which is the basis for the construction and acceptance of key laboratories.

Article 14 The supporting unit shall, according to the requirements of the construction plan of the key laboratory of the Ministry of Land and Resources approved by the competent department, organize the open recruitment of the director of the key laboratory, propose the candidate for the director of the academic committee, organize the construction of the key laboratory, and provide corresponding supporting conditions and necessary operating funds.

Fifteenth key laboratory construction period is generally not more than 3 years. During the construction period, we should adhere to the principle of "opening while building", strengthen the organizational construction of key laboratories, and maintain the stability of core personnel of key laboratories.

Sixteenth after the completion of a construction project, it shall apply to the competent department for acceptance. The supporting unit shall submit the application for construction acceptance of the key laboratory of the Ministry of Land and Resources 6 months before the expiration of the construction period, and submit it to the competent department after being audited by the competent unit. If the construction cannot be completed on schedule, an application for extending the construction period shall be submitted six months before the scheduled construction period expires, and the reasons shall be explained. The longest extension period is 1 year.

Seventeenth departments in accordance with the acceptance application, organize experts to check and accept the construction of key laboratories. The expert group is generally composed of 7 or 9 technical experts and management experts in related fields.

Eighteenth key laboratory acceptance work to implement the avoidance system. Acceptance experts who have an interest in the construction and operation of key laboratories shall take the initiative to apply for withdrawal.

Article 19 The procedures for on-site acceptance of key laboratories are: director's reports of key laboratories, important academic reports, on-site visits by expert groups, questions and answers, and the expert groups discuss and form acceptance opinions. The opinions of the expert group are divided into three types: acceptance, acceptance after rectification within a time limit, and rejection.

Twentieth key laboratories that have passed the acceptance can be officially put into operation only after being approved by the competent department.

Chapter IV Operation Management

Twenty-first key laboratories shall implement the director responsibility system under the guidance of unit leaders and academic committees. Qualifications of the Director of Key Laboratory:

(1) Academic leaders in this field;

(2) Strong organizational and management skills;

(3) Good health, generally no more than 55 years old;

(4) Working in the laboratory for not less than 8 months every year.

Article 22 The Academic Committee is the academic guidance institution of key laboratories, and its main tasks are: to review the objectives, research directions, development plans, major academic activities, annual work plans and annual summaries of key laboratories; Participate in important academic activities and guide academic research; Put forward opinions and suggestions on the development, cooperation and opening of key laboratories. The Academic Committee shall hold a plenary meeting at least once a year, and the actual number shall not be less than two thirds.

Article 23 The academic committee consists of outstanding experts at home and abroad in this field, and the chairman of the academic committee shall be a well-known expert at home and abroad with high academic reputation in this field. Members of the academic committee shall have full and senior titles, and the number shall generally not exceed 20, of which no more than 1/3 are members of supporting units. The same expert shall not be a member of the academic committee of more than three key laboratories at the same time.

The director of the academic committee is recommended by the supporting unit, appointed by the competent department, and generally held by non-supporting unit personnel; The vice-chairmen and members of the academic committee shall be appointed by the supporting units for a term of five years, and the number of people who change each time shall not be less than one third.

Article 24 The research teams of key laboratories are composed of fixed personnel such as researchers, technicians and managers, and floating personnel such as visiting professors, visiting scholars and postdoctoral researchers. The key laboratory personnel shall be appointed, and the scale of fixed personnel and floating personnel shall be determined by the director of the key laboratory according to the research needs.

Twenty-fifth key laboratories set up research units according to the research direction and content, and maintain a reasonable personnel structure and scale. Gradually expand the proportion of open research and mobile personnel. Key laboratories should attach importance to the construction of academic echelon and outstanding young and middle-aged teams, stabilize high-level technical teams, and strengthen the training of young scientific and technological innovation talents.

Twenty-sixth key laboratories should organize teams to carry out continuous and in-depth systematic research around the main tasks and research directions, pay attention to supporting young scientific and technological personnel, encourage innovative research on experimental techniques and methods, and support the scientific research and entrepreneurship of newly introduced fixed personnel. Key laboratories should increase their openness and become public research platforms in this field; Actively carry out international scientific and technological cooperation and exchanges and participate in major international scientific and technological cooperation plans.

Twenty-seventh key laboratories should set up open research topics, and apply freely to researchers in related fields at home and abroad to carry out exploratory and independent research on the topics. Key laboratories should regularly check the implementation of open research projects and accept them in time. The project acceptance adheres to the principle of "encouraging innovation, qualitative evaluation and tolerating failure".

Twenty-eighth key laboratories should establish a visiting scholar system, and attract high-level researchers at home and abroad to carry out cooperative research in the laboratory by participating in research and undertaking open projects.

Twenty-ninth key laboratories should carry out the renovation and independent research of scientific research instruments and equipment in a planned way to ensure the efficient operation and open access of scientific research instruments. Instruments and equipment shall be managed by special personnel, and all instruments and equipment that meet the opening conditions shall be open to the outside world, and data access shall be implemented in accordance with relevant regulations and requirements.

Thirtieth key laboratories should attach importance to the construction of scientific ethics and style of study, create a relaxed and democratic research environment, and carry out regular and various forms of academic exchange activities.

Thirty-first key laboratories should combine their own characteristics, promote the transformation of scientific and technological achievements, and strengthen contact and cooperation with the industry. Advocate the construction of key laboratories, encourage relevant enterprises, governments and individuals to donate instruments and equipment to laboratories in different forms, and set up visiting scholar funds and postgraduate scholarships.

Thirty-second key laboratories should strengthen the protection of intellectual property rights. Research results (monographs, papers, patents, software, databases, experimental data, etc. If it is completed by the fixed personnel and floating personnel of the key laboratory, the name of the key laboratory shall be standardized and signed, and the patent application and transfer of technological achievements shall be handled in accordance with the relevant provisions of the state. The fixed personnel of key laboratories who study, research and engage in guest research abroad, involving laboratory work and achievements, should also standardize the names of key laboratories when publishing papers and monographs. Declaring awards shall be handled in accordance with relevant regulations.

Thirty-third key laboratories should establish and improve various rules and regulations, and strengthen internal management and laboratory quality construction. It is necessary to strengthen the scientific and authentic audit and preservation of scientific research data to ensure the quality of scientific research work.

Thirty-fourth key laboratories should establish a system of popularization of science and be open to the public, especially students, for not less than ten days every year. Key laboratories should strictly abide by the relevant national confidentiality regulations, and should abide by the relevant regulations of supporting units when publishing results and related information.

Key laboratories shall not set up business entities or branches in their names, and shall not engage in or participate in commercial activities for profit.

Chapter V Changes and Adjustments

Thirty-fifth according to the needs of scientific and technological innovation and research development and the operation of key laboratories, the competent department may adjust the layout, research direction and composition of key laboratories, and reorganize, integrate and cancel key laboratories.

Article 36 If it is really necessary to rename, adjust or reorganize a key laboratory, the director of the key laboratory shall submit a written report, which shall be demonstrated by the academic committee or experts in related disciplines, and the supporting unit shall report it to the competent department in an official document, and the corresponding changes and adjustments can be made only after approval.

Chapter VI Evaluation and Evaluation

Thirty-seventh key laboratories shall submit the annual work report of the key laboratories of the Ministry of Land and Resources before the end of April each year, and report it to the competent department after being audited by the superior competent unit. Relying on the unit shall conduct an annual evaluation of key laboratories, and the evaluation results shall be reported to the competent department for the record. The main purpose of annual evaluation is to understand the development status and existing problems of key laboratories.

Article 38 The competent department shall, according to the work arrangement, jointly with relevant departments and support units, conduct on-site inspection on some key laboratories every year to discover, study and solve the problems existing in key laboratories. The contents of on-site inspection mainly include: listening to the work report of the laboratory director, inspecting the laboratory and holding a forum.

The competent department shall regularly evaluate the key laboratories. The evaluation mainly evaluates the overall operation of key laboratories, and the indicators include: research level and contribution, team building and personnel training, open communication and operation management. The evaluation work adheres to the evaluation concept of "relying on experts, promoting democracy, seeking truth from facts, being fair and reasonable" and follows the principle of "openness, fairness and justice".

Thirty-ninth according to the regular evaluation results of key laboratories, combined with the annual evaluation, determine the evaluation results of key laboratories. The evaluation of outstanding key laboratories will give preferential support in terms of policies, projects, talents and base construction; The Ministry of Land and Resources will notify the key laboratories that fail to pass the evaluation and give them two years to rectify. Those who fail to pass the re-evaluation after rectification will be disqualified from the key laboratory.

Chapter VII Supplementary Provisions

Fortieth key laboratories shall be uniformly named as "Key Laboratory of Ministry of Land and Resources", and the English name shall be "Key Laboratory of Ministry of Land and Resources".

Forty-first departments (bureaus) can formulate measures for the management of key laboratories in their own units according to these measures.

Article 42 These Measures shall come into force as of the date of promulgation and shall be valid for 5 years.
