Automobile Auto-First learned from the official website of Shanghai Higher People's Court that the case of Geely Automobile suing Weimar for intellectual property disputes will continue in the ninth court of Zhangheng Road, Shanghai on November 19, 22. Weimar Automobile, founded in 215, was sued by Geely Automobile in 218. Geely believes that Weimar Automobile's new suspension assembly structure, battery pack heating device and heating method, vacuum tank assembly for pure electric vehicles and many other patents infringe. The inventors of these patents were several technical backbones of Chengdu Plateau Automobile Company, a subsidiary of Geely.
According to Auto-First, Geely filed an infringement lawsuit against Weimar in Chengdu Intermediate People's Court, and later appealed to the Supreme People's Court because Weimar Automobile, arguing that the jurisdiction of the case should not be in Chengdu. the Supreme People's Court supported Weimar Automobile's complaint, and then Geely related companies withdrew the lawsuit in Chengdu. Geely Automobile, determined to protect its own rights and interests, soon put Weimara in the dock in Shanghai.
Previously, Geely Automobile filed a lawsuit against Weimar Smart Travel Technology Company in Hangzhou Intermediate People's Court. Geely believes that Zhang Xuekui and Leng Feihu, employees of Chengdu Plateau Company, the former subsidiary of Geely Automobile Group, applied for related intellectual property rights in Weimar Automobile, which involved infringement. Hangzhou Intermediate People's Court ruled that Weimar Automobile was involved in infringement. Later, because the Supreme People's Court decided that the court of first instance had no jurisdiction, the case should be under the jurisdiction of the Shanghai Intellectual Property Court, which ruled that the facts and applicable laws were accurate. Although Geely also appealed to the Supreme People's Court, expressing the rationality of the jurisdiction of the Hangzhou Intermediate People's Court, the Supreme People's Court rejected it.
Since May this year, the case has been tried by the Shanghai Higher People's Court. As Geely refuses to hold a public hearing, the substantive progress is still unknown. Some experts said that the biggest difficulty in similar intellectual property cases lies in the proof, and it is expected that the case will not end in a short time.
Freeman Shen, the founder of Weimar Automobile, has worked for Geely Group for many years, making great contributions to Geely's acquisition of Volvo. At the end of 214, he resigned from senior positions as Vice President of Geely Holding, Senior Vice President of Volvo Global and Chairman of Volvo Car China. Later, he joined Botai Group and planned to build a car with Ying Yilun. Eight months later, Ying Yilun gave up the idea of building a car, and then Freeman Shen founded Weimar Automobile. Weimar EX5 went public, and some media quoted Geely as saying that Hou, a former general manager of Geely Chengdu manufacturing base, took all the information of Geely GX7 to join Weimar Automobile in 218, and developed Weimar EX5 on the basis of relevant information.
In the ruling that Chengdu Plateau Company, a subsidiary of Geely, sued Weimar, three former Geely technicians were involved: Kou Xinchen, Zhong Xingyuan and Xiang Jianming, who joined Weimar Automobile after leaving Geely and served as ADAS senior manager of Chengdu Weimar Automobile Research Institute, Weimar Automobile electronic designer and Weimar Automobile new energy director respectively. In Weimar, three people applied for dozens of patent information.
According to Auto-First, Weimar Automobile established its global R&D headquarters in Chengdu in September 218. At the beginning of the establishment of the research institute, Chengdu Geely related company became the "Whampoa Military Academy" of Weimar Automobile. Zhou Yiping, former deputy general manager of Chengdu Plateau Company, served as the president and vice president of Weimar Automobile Research Institute, and Luo Sizhou had previously worked in Geely's technical department.
Weimar Automobile has completed the D round of financing in September, which involves SAIC's follow-up investment. Obviously, the investment company will not ignore Geely's lawsuit against Weimar Automobile, and will make a comprehensive assessment of Weimar's related risks. Now that the investment has been settled, it seems that Geely's case against Weimar will not make a big wave again.
However, from Geely's persistent appeals, we can see that many former employees of Geely have angered their old employers.
