The State Council Order (No.76)-Patent Agency Ordinance
Article 19 stipulates that
Those who have obtained the patent agent qualification certificate and have not been engaged in patent agency business or patent management within five years will automatically lose their patent agent qualification certificate.
However, please note that the above provisions have been cancelled in the draft Patent Agency Regulations, but they have not yet come into effect and need to be verified.
In other words, after obtaining the qualification of patent agent, you need to practice in a patent agency or related post for one year before you can issue a practice license. In other words, if you don't do relevant internship within five years, you will be disqualified as a patent agent.
If you have been engaged in related work for five years, there are two situations:
1. After one year's internship, if you are issued with a practicing certificate, you must have an annual inspection, otherwise it will be handled by the agent association.
2, internship less than one year and no longer engaged in related work, leaving the affiliated unit (agency or patent management post) for five years, disqualification.
