What is a submarine patent?

A submarine patent refers to a patent that suddenly takes effect after it has been hidden for decades in a private state after an enterprise has filed a patent application. Broadly speaking, submarine patents are sometimes manifested as patents that were unknown to the world before the market was formed, but after the market was formed, the patentee suddenly began to ask users to pay the licensing fee. Article 2 of the Patent Law Inventions and creations mentioned in this Law refer to inventions, utility models and designs. Ming refers to the new technical scheme proposed for products, methods or their improvement. Utility model refers to a new practical technical scheme for the shape, structure or combination of products. Appearance design refers to a new design that is aesthetically pleasing and suitable for industrial application, which is based on the shape, pattern or their combination of products and the combination of color, shape and pattern.
