Chapter I General Provisions Article 1 In order to continuously optimize the business environment, safeguard the legitimate rights and interests of market participants, stimulate market vitality and promote high-quality development, these Regulations are formulated in accordance with the Regulations of the State Council on Optimizing the Business Environment, the Regulations of Shandong Province on Optimizing the Business Environment and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to activities related to optimizing the business environment within the administrative area of this Municipality. Article 3 To optimize the business environment, we should adhere to the principles of marketization, rule of law and internationalization, take the needs of market players as the guide, and take the transformation of government functions as the core to create a stable, fair, transparent and predictable development environment. Article 4 People's governments at all levels shall strengthen the organization and leadership over the work of optimizing the business environment, improve the policies and measures for optimizing the business environment, establish relevant mechanisms to promote and supervise the implementation of the overall work of optimizing the business environment, and coordinate and solve major problems in the work of optimizing the business environment in a timely manner.

The development and reform department is the competent department in charge of optimizing the business environment and is responsible for taking the lead in promoting the optimization of the business environment. Other relevant departments and units shall, according to their respective responsibilities, do a good job in optimizing the business environment. Article 5 Market participants have equal rights, equal opportunities and equal rules in market economic activities. The property rights and other legitimate rights and interests of market participants and the personal rights, property rights and other legitimate rights and interests of business operators are protected by law, and no organization or individual may infringe upon them.

Market participants should abide by laws and regulations, strictly abide by social morality and business ethics, be honest and trustworthy, compete fairly, fulfill their legal obligations in terms of safety, quality, tax payment, ecological environment protection, farmland protection, workers' rights and interests protection, and consumers' rights and interests protection, and follow the internationally accepted rules in international economic and trade activities. Article 6 The people's governments of cities and counties (cities, districts) and their relevant departments shall, in light of the actual situation, explore concrete and feasible new methods and measures to optimize the business environment within the framework of the rule of law, and replicate and popularize the effective reform experience.

For those units and individuals who fail to achieve the expected goals due to inexperience, trial-and-error and exploratory test errors, but are in line with the reform direction set by the state and the province, are conducive to optimizing the business environment, and the decision-making procedures are in line with laws and regulations, and have not sought personal gain or harmed public interests, they should be given a lighter punishment in accordance with relevant regulations. Article 7 Fully connect with the integrated development of the provincial capital economic circle, cooperate with relevant cities to promote the optimization of the business environment, and strive to form a unified open market with free flow of factors.

Strengthen cooperation with urban industries, transportation and logistics, business travel culture, ecological protection and other fields in the Yellow River Basin, deeply integrate into the coordinated development strategy of Beijing, Tianjin and Hebei, and promote all-round open development. Article 8 People's governments at all levels, relevant departments and news media should strengthen the publicity of laws, regulations, rules and policies and measures to optimize the business environment, popularize typical experiences, and create an open, inclusive, mutually beneficial, cooperative, honest and trustworthy social atmosphere. Chapter II Market Environment Article 9 The people's governments of cities and counties (cities, districts) and their relevant departments shall, in accordance with the law, ensure equal treatment of all kinds of market participants and participate in market competition fairly, and shall not formulate or implement discriminatory policies. Article 10 The relevant departments of the people's governments of cities and counties (cities, districts) shall intensify law enforcement against unfair competition, investigate and deal with market chaos, commercial bribery, false propaganda, infringement of trade secrets, unfair prize-winning sales, commercial slander and unfair online competition in market economic activities according to law, and create a fair market environment. Article 11 The people's governments of cities and counties (cities, districts) shall improve the trading system of public resources, establish and publish the trading list of public resources, and ensure that all kinds of market participants can obtain relevant information in time and participate in trading activities on an equal footing.

The competent department of public resources trading shall, jointly with relevant departments, implement the whole process of public resources trading electronically, disclose the trading catalogue, procedures, results and credit information, and optimize trading rules, trading processes and trading services.

Bidding and government procurement should be open, transparent, fair and just, and market players of all types of ownership and different regions should be treated equally according to law, and restrictions or exclusions should not be made on the grounds of unreasonable conditions or product origin.

Strengthen the comprehensive management of public * * * resource transactions, and correct and investigate violations of laws and regulations according to law.

We will comprehensively promote the use of financial institution guarantees instead of cash to pay enterprise-related deposits, reduce transaction costs of market participants, and improve transaction quality and efficiency. Twelfth city, county (city, district) people's governments and their relevant departments should improve the support policies and incentives for innovation and entrepreneurship, increase financial investment in science and technology, improve the efficiency of capital utilization, and guide the whole society to continuously increase investment in research and development; Encourage and support the construction of scientific and technological innovation platforms, strive for the landing of major national scientific and technological innovation platforms, increase the cultivation of small and medium-sized scientific and technological enterprises, and support enterprises to declare national high-tech enterprises; Encourage market players to carry out joint innovation research with universities and scientific research institutions, improve the supply capacity of scientific and technological innovation, promote the transformation of scientific and technological achievements, and reduce the cost of innovation and entrepreneurship. Article 13 The people's governments of cities and counties (cities, districts) shall organize the establishment of a public service platform for intellectual property rights, so as to provide convenience for market participants in intellectual property transactions, pledge financing, patent retrieval, patent navigation and analysis and early warning.

City, county (city, district) people's governments and their relevant departments shall establish the working mechanism of intellectual property protection according to law, improve the service function of China (Dezhou) Intellectual Property Protection Center, shorten the time of patent preliminary examination, and realize rapid examination, rapid confirmation and rapid rights protection; Establish a national intellectual property protection center around characteristic industries and implement one-stop protection of intellectual property rights; Implement a punitive compensation system for intellectual property infringement according to law to protect the legitimate rights and interests of obligees.
