Regulations of Yunnan Province on Scientific and Technological Progress (20 1 1 Revision)

Chapter I General Provisions Article 1 In order to promote the progress of science and technology, give full play to the role of science and technology as the primary productive force, accelerate the transformation of scientific and technological achievements into real productive forces, and promote the economic and social development of this province, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Progress of Science and Technology and other laws and regulations, combined with the actual situation of this province. Article 2 Scientific and technological work should adhere to the guiding principles of independent innovation, focusing on leapfrogging, supporting development and leading the future, and build a regional innovation system with the characteristics of this province and innovative Yunnan around the implementation of the strategy of rejuvenating the province through science and education, strengthening the province with talents and sustainable development. Article 3 Promoting scientific and technological progress is the common responsibility of the whole society.

State organs, enterprises and institutions, social organizations and private non-enterprise units shall respect labor, knowledge, talents and creativity, protect intellectual property rights and popularize scientific and technological knowledge. Article 4 People's governments at all levels shall lead the work of scientific and technological progress within their respective administrative areas and incorporate it into the national economic and social development plan; Develop the popularization of science and technology and improve the scientific and cultural quality of citizens; Take effective measures to promote scientific and technological progress.

Provincial and state (city) people's governments organize the formulation of scientific and technological development plans, establish and improve the coordination mechanism of scientific and technological progress, study and solve major problems in scientific and technological progress, and promote the coordinated development of scientific and technological progress and economy and society. Article 5 The administrative department of science and technology of the people's governments at or above the county level shall be responsible for the management, coordination, service and popularization of scientific and technological progress within their respective administrative areas, organize the implementation of scientific and technological development plans and special plans, and conduct scientific and technological assessments jointly with relevant departments.

Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the related work of scientific and technological progress. Article 6 People's governments at all levels and relevant departments shall strengthen guidance on scientific and technological progress in ethnic minority areas, border areas and poverty-stricken areas, implement preferential policies to promote scientific and technological progress, help cultivate local scientific and technological talents, and accelerate the popularization and application of scientific and technological achievements. Article 7 People's governments at all levels should strengthen scientific and technological cooperation and exchanges at home and abroad, attract innovative elements such as technology, talents, capital and information, and establish scientific and technological cooperation research centers, joint laboratories, R&D bases or industrialization demonstration bases.

Encourage enterprises, universities, research institutes, scientific and technological personnel and other social forces to participate in and support scientific and technological progress activities, research and develop scientific and technological achievements with independent intellectual property rights and implement effective transformation. Article 8 The people's governments at or above the county level shall establish a science and technology award system to commend and reward units and individuals that have made outstanding contributions in the work of scientific and technological progress.

Encourage social forces to set up science and technology awards. Chapter II Scientific and Technological Research and Development and the Popularization and Application of Achievements Article 9 People's governments at all levels should attach importance to scientific research, technological development and the popularization and application of achievements, build a public scientific and technological service platform, establish and improve a scientific and technological innovation service system, promote the effective transformation of scientific and technological achievements, and gradually form industrialization. Article 10 People's governments at all levels shall establish and improve the service system for agricultural science and technology innovation and extension, attach importance to the research, development and application of new agricultural technologies and varieties, establish experimental demonstration and extension bases for agricultural technological achievements and comprehensive development zones for agricultural resources, cultivate agricultural scientific and technological enterprises, strengthen agricultural practical technical training and improve farmers' ability to use scientific and technological achievements. Eleventh people's governments at or above the county level and relevant departments should strengthen scientific and technological research and development in the fields of resources and environment, disaster prevention and mitigation, population health, public safety, cultural tourism and urban and rural construction; Organize technology research and development in mining and metallurgy, chemical industry, biological resources, energy, energy conservation and environmental protection, new materials, electronic information, advanced manufacturing and other industries; Enhance the ability to transform traditional industries with high technology. Twelfth provincial people's government and relevant departments shall establish the identification system of independent innovation products and services, the system of purchasing independent innovation products and services with financial funds, and establish the risk compensation mechanism for using the first independent innovation equipment; Regularly publish the catalogue of independent innovation products to increase the proportion of independent innovation products and services in government procurement.

Products independently developed by enterprises, institutions of higher learning and scientific research institutes in this province meet the government procurement standards and product catalogues and have independent intellectual property rights. If they are put on the market for the first time, government procurement should give priority to procurement when performance, technology and other indicators can meet the government procurement needs.

The use of financial funds to purchase major equipment and products for construction projects shall promise to purchase the proportion of independent innovation products, among which the proportion of key projects invested by the government to purchase domestic equipment shall meet the relevant requirements of the state and this province. Article 13 Where the patentee of a patent for invention or utility model fails to exploit or not fully exploit his patent for three years from the date of the grant of the patent right or four years from the date of the patent application, the entity or individual with the conditions for exploitation may apply for compulsory license according to law.

The project undertaker shall legally implement the invention patent right, computer software copyright, integrated circuit layout design exclusive right and new plant variety right formed by scientific and technological projects mainly funded by financial funds, and submit an annual report on the implementation and protection to the project management institution; If it meets the implementation conditions and is not implemented within 1 year without justifiable reasons, the project management institution may organize the implementation free of charge according to law, or may license others to implement it with or without compensation.
