Can prisoners in custody apply for patents?

Article 78, paragraph 3, of the "Criminal Law" and Article 29, paragraph 3, of the "Prison Law" stipulate that inmates who obtain invention patents can receive rewards such as reduced sentences. Because if there is an invention or major technological innovation, it can be regarded as meritorious service (depending on the benefits generated by the patent and the size of the contribution, major meritorious services, meritorious services, awards, praises, etc. can be obtained), and meritorious service can be used as a necessary condition for commutation of the sentence. The basis for calculating the range of sentence reduction is not a sufficient condition. Applying for a patent for this purpose can lead to a reduction in sentence. Article 29 A criminal sentenced to life imprisonment or fixed-term imprisonment shall, after serving his sentence, If there is genuine repentance or meritorious service during the period, the sentence may be reduced based on the results of the prison assessment. Anyone who has performed any of the following major meritorious services shall be given a reduced sentence

:

(1) Preventing others from major criminal activities;

(4) Sacrificing oneself to save others in daily production and life;

(5) Those who have outstanding performance in resisting natural disasters or eliminating major accidents;

Article 78 Criminals sentenced to public surveillance, criminal detention, fixed-term imprisonment, or life imprisonment shall, during the execution period, if they conscientiously abide by the prison regulations , accept education and reform, and truly show repentance, or perform meritorious service, the sentence may be reduced; if the person performs one of the following major meritorious services, the sentence shall be reduced:

(1) Preventing other people from major criminal activities;

(4) Sacrificing oneself to save others in daily production and life;

(5) Having outstanding performance in resisting natural disasters or eliminating major accidents;

The actual term of the sentence after commutation, if sentenced to public surveillance, criminal detention, or fixed-term imprisonment, shall not be less than one-half of the original sentence; if sentenced to life imprisonment, it shall not be less than ten years.
