Other relevant administrative departments shall, in accordance with their respective functions and duties, be responsible for supervising and inspecting the bidding activities of engineering construction projects and other projects in this industry. Article 4 The following construction projects shall be subject to tender in accordance with these Measures.
(1) Infrastructure projects related to social interests and public safety, including:
1, energy projects such as coal, oil, natural gas, electric power and new energy (including wind energy, solar energy and geothermal energy);
2, railways, highways, pipelines, water transport, aviation and other transportation projects;
3, postal services, telecommunications hubs, communications, information networks and other post and telecommunications projects;
4, flood control, irrigation, drainage, water diversion (supply), water conservancy projects;
5, agriculture, animal husbandry, forestry and other agricultural comprehensive development projects;
6 roads, bridges, sewage discharge and treatment, garbage disposal, underground pipelines, public parking lots and other urban facilities;
7. Ecological environmental protection projects;
8. Other infrastructure projects.
(two) public utility projects related to social interests and public safety, including:
1, municipal engineering projects such as water supply, power supply, gas supply and heating;
2, science and technology, education, culture and other projects;
3. Sports, tourism and other projects;
4, health, social welfare and other projects;
5. Commercial housing, including affordable housing;
6. Other public utility projects.
(three) the use of state-owned capital investment projects include:
1, projects using financial budget funds at all levels;
2, the use of poverty alleviation, work relief funds projects;
3, the use of various government special construction funds included in the financial management of the project;
4, the use of state-owned enterprises and institutions of their own funds, and the state-owned assets investors actually have control of the project.
(four) autonomous region financing projects include:
1. Projects financed by bonds issued by the state;
2, the use of foreign loans or guarantees raised by the state and the autonomous region;
3, the use of national policy loans projects;
4, the state, the autonomous region authorized investment financing projects;
5. State-chartered financing projects.
(5) Projects using funds from international organizations or foreign governments, including:
1, projects using loan funds from international organizations such as the World Bank and the Asian Development Bank;
2. Projects using loan funds from foreign governments and their institutions;
3, the use of international organizations or foreign government assistance projects. Article 5 If the survey, design, construction, supervision and procurement of important equipment and materials related to engineering construction within the scope specified in Article 4 of these Measures meet one of the following standards, bidding must be conducted:
(a) the estimated price of a single construction contract is more than 6.5438+0 million yuan, including more than 500,000 yuan for housing construction and civil engineering, and more than 300,000 yuan for decoration engineering;
(two) the procurement of important equipment, materials and other goods, the estimated price of a single contract is more than 500 thousand yuan;
(three) the estimated price of a single contract for the procurement of services such as survey, design and supervision is more than 200,000 yuan;
(four) the estimated price of a single contract is lower than the standards stipulated in items (1), (2) and (3), but the total investment of the project is more than 5 million yuan.
For projects that do not meet the standards specified in the preceding paragraph, it is up to investors to decide whether to invite tenders. Sixth according to the relevant provisions of the state or approved by the competent department of the project, the following projects may not be subject to tender:
(a) projects involving national security, state secrets and confidentiality requirements;
(2) Emergency engineering projects for emergency rescue and disaster relief;
(three) projects that focus on the labor input of farmers and herdsmen, with poverty alleviation and work-based relief funds as subsidies;
(four) the survey and design of construction projects, the use of specific patents or proprietary technology, or its architectural artistic modeling has special requirements. Seventh Autonomous Region Development Planning Commission may, according to the actual needs, in conjunction with the relevant administrative departments of the autonomous region, make some adjustments to the specific scope and scale standards of engineering construction projects that must be subject to tender as stipulated in these Measures. Article 8 When examining and approving the feasibility study report of a project or the preliminary design scheme of a project that must be subject to tender, the project examination and approval department shall examine and approve the tender method (open tender or invitation tender) and tender form (entrusted tender or self-tender) of the project and the tender scope (preliminary scheme for contracting out) of the project funded by the state. After the project is examined and approved, it shall promptly notify the relevant administrative departments of the determined bidding method and scope.
