What is applicable to Paris Convention countries?
China is a member of the Paris Convention for the Protection of Industrial Property (hereinafter referred to as the Paris Convention), and the "priority principle" of the Paris Convention is clearly embodied in China's patent law. According to the first paragraph of Article 29 of the Patent Law, the applicant may file an application for a patent for invention or utility model in China for the first time within 12 months, or within 6 months from the date of filing an application for a patent for design in China for the first time.
