After the contract comes into effect and before the transfer registration, the transferor's use of the patent is regarded as a breach of contract, and the transferee enjoys the right to use the patent. Although the patent transfer has not yet taken effect, the purpose of the contract is to transfer the patent. If the transferor still has the right to use the patent, the contract is essentially an exclusive license for the patent.
After the registration of patent transfer, the transferor's use of the patent belongs to the concurrence of infringement and breach of contract, and the transferee has the right to ask the transferor to bear the liability for infringement or breach of contract.
If the contract stipulates that the transferor has the right to continue to use the patent after the patent is transferred, it shall be regarded as a patent license, and the licensor shall be the transferee.
