The so-called foreign priority refers to the fact that the applicant filed an application for a patent for invention or utility model for the first time in a foreign country within 12 months, or filed an application for a patent for design for the first time in a foreign country within 6 months, and filed a patent application for the same subject in China, which can be based on the agreement signed between the foreign country and China, the international treaty to which * * * is a party, or the principle of mutual recognition of priority, that is, the applicant enjoys the priority for the first time in a foreign country. The principle is also applicable to patent applications filed by China applicants abroad.

Domestic priority, also known as "domestic priority", means that the patent applicant applies for a patent for an invention or utility model with the same theme for the first time in China within 12 months, and can enjoy priority. In China's priority system, design patents are not included.

Foreign priority, also known as "foreign priority", means that the patent applicant filed a patent application in China within 12 months from the date when he first filed a patent application for an invention or utility model with the same theme in a foreign country, or filed a patent application in China within 6 months from the date when he first filed a patent application for a design with the same theme in a foreign country, and the date when he first filed a patent application in a foreign country is the priority date.

Foreign priority means that foreigners have applied for patents abroad before. When applying in China, as long as the priority period does not exceed, the application date will be calculated for you when applying abroad.
