(1) Enterprises applying for three-level qualification of construction general contracting sequence, three-level qualification of professional contracting sequence and three-level qualification of labor subcontracting sequence shall be directly accepted by the construction administrative departments of the people's governments of all districts and cities and granted permission. The construction administrative department of the people's government of each district and city shall, within 3 days from the date of making the licensing decision, report the decision to grant the qualification license to the Provincial Construction Department for the record, and attach the Record Form for the Qualification Examination and Approval of Construction Enterprises by Municipalities (see Annex 1) and the electronic document of the record form.
(2) Enterprises applying for Grade III general contracting qualification and Grade III professional contracting qualification involving transportation, water conservancy, information industry, railways and civil aviation shall be accepted by the construction administrative departments of the people's governments of all districts and cities, and the application materials shall be submitted to the Construction Department in a unified manner according to the acceptance time specified by the Construction Department. When submitting the application, the Construction Enterprise Qualification Application Filing Form (see Annex 2) and the electronic document of the filing form shall be attached, which shall be sent by the Provincial Construction Department to the relevant provincial departments for review.
(3) Enterprises applying for the second-level qualification of construction general contracting sequence, the first-level qualification of professional contracting sequence approved by the Provincial Construction Department, the second-level qualification of professional contracting sequence and the qualification of professional contracting regardless of grade shall be accepted by the municipal administrative department of construction in the district where the enterprise is registered, and the application materials shall be submitted to the Construction Department in a unified manner according to the acceptance time specified by the Construction Department. When submitting the application, the Provincial Construction Department shall attach the Record Form for Qualification Application of Construction Enterprises (see Annex 2) and the electronic document of the record form for approval.
(4) The construction general contracting premium, first-class qualification and professional contracting qualification licensed by the Ministry of Construction shall be directly accepted by the Provincial Construction Department.
(5) The central enterprises in Shaanxi, the provincial SASAC management enterprises and their subordinate enterprises and the subordinate enterprises of other provincial departments and bureaus apply for the qualification of construction enterprises, and directly report to the Provincial Construction Department for acceptance and make a licensing decision.
(6) The enterprise has obtained the general contracting qualification for construction, and can undertake various professional contracting projects within the scope of the general contracting qualification. The general contracting enterprise shall have the corresponding professional contracting category qualification when bidding or contracting the professional projects beyond its general contracting coverage; The general contracting enterprise shall not apply for the qualification of labor subcontracting category.
(7) if an enterprise applies for a certain qualification of a construction enterprise for the first time and fails to assess the engineering performance of the enterprise, its qualification grade shall be approved according to the lowest grade.
if an enterprise that has obtained the qualification of engineering design applies for the qualification of the same or similar construction enterprise for the first time, it can declare the general contracting performance of the corresponding scale as the engineering performance, but the highest application qualification level does not exceed its existing engineering design qualification level.
(8) The qualification certificates of construction enterprises are divided into originals and duplicates, and the qualification certificates are valid for 5 years.
start time of validity period: the start time is calculated by taking the date when the enterprise first obtained the highest-level qualification as the validity period of the qualification certificate. If the qualification of an enterprise changes, the validity period will remain unchanged, and if it involves the upgrading of major items, or the division or merger, the new approval time will be the starting date of the validity period.
II. Application materials
To apply for qualification, an enterprise must provide an Application Form for Qualification of Construction Enterprises (including electronic documents) and corresponding attachments, and bind them in the following order:
(1) Comprehensive materials (Volume I):
1. A copy of the business license of the enterprise as a legal person;
2. Original and duplicate of enterprise qualification certificate;
3. Articles of Association;
4. Statistical statements of the construction industry of the enterprise in recent three years;
5. The audited financial statements of the enterprise for the last three years;
6. Employment documents and identity certificates of the legal representative of the enterprise;
7. The identity certificate, professional title certificate, post-holding documents of the enterprise manager and the technical and financial person-in-charge and the engineering performance certification materials of the technical person-in-charge representative required by relevant qualification standards;
8. if there are requirements for equipment and workshop, relevant certificates such as equipment purchase invoice or lease contract, house title certificate or lease contract of the workshop, and other materials required by relevant qualification standards shall be provided.
9. Enterprise safety production license (labor subcontracting enterprises, concrete precast component enterprises, ready-mixed commercial concrete and other enterprises may not provide it)
Among them, enterprises applying for qualification for the first time do not need to provide the materials mentioned in 2, 4, 5 and 9 above, but should provide the documents of enterprise safety production management system.
1. To apply for special qualification, in addition to the above materials, it should also provide:
(1) the bank credit certificate of the enterprise in recent three years;
(2) The enterprise has handed over the business tax receipts of the construction industry or the project settlement vouchers of overseas projects in the past three years;
(3) Certificates or valid approval documents certified by enterprise technology (R&D) centers or sub-centers at or above the provincial or ministerial level;
(4) identification documents of national construction method and identification certificate of patented technology;
(5) a copy of the national science and technology progress award certificate or the notice (or order) on the release of the national and industrial standards for engineering construction, cover, contents, preface and introduction.
(II) Personnel information (Volume II):
1. Identity certificates and registration certificates of registered personnel listed in the application form for qualification of construction enterprises;
2. Professional title certificate, identity certificate and endowment insurance certificate of unregistered professional and technical personnel required by the qualification standards of construction enterprises;
3. Some qualification standards require enterprises to have professional title certificates, identity certificates and endowment insurance certificates of special professional and technical personnel, and should also provide corresponding certificates and certification materials reflecting their majors;
4. The subcontracting enterprise shall provide the post certificates and identity certificates of personnel required by the standards.
(3) Engineering performance data (not provided for applying for the lowest level qualification) (Volume III):
1. Engineering contract and letter of acceptance;
2. Completion acceptance list (record form) or quality verification data conforming to national regulations;
3. If the above data can't reflect the technical indicators, it should also provide engineering photos, drawings and final accounts data that reflect the requirements of the technical indicators.
(4) If the qualification needs to be re-approved when an enterprise applies for restructuring, division or merger, it shall provide the following information (included in the comprehensive materials in Volume I) in addition to the above information:
1. The plan for enterprise restructuring, division and merger (including the division of assets, personnel and engineering achievements between the new enterprise and the original enterprise);
2. The approval document of enterprise restructuring, division and merger or the resolution of shareholders' meeting or workers' congress;
3. The financial statements and statistical statements of the enterprise in the last three years before the restructuring and division shall be provided for the restructuring and division of the enterprise;
4. For business combination, the financial statements, statistical statements and latest consolidated statements of each enterprise in the last three years before the merger shall be provided;
5. capital verification report issued by accounting firm.
(5) If an enterprise with engineering design qualification applies for the qualification of the same or similar construction enterprise for the first time, its application materials shall provide all the materials listed in the first application, and if it applies for the lowest level of construction general contracting qualification, it shall also provide all the materials required in Article (3).
III. Requirements for application materials
1. The Application Form for Qualification of Construction Enterprises is in quadruplicate, with one set of attachment materials. Where the qualifications of railway, transportation, water conservancy, information industry, civil aviation and other professional departments are involved, two copies of the Application Form for Qualification of Construction Enterprises and one set of attachment materials shall be added for each professional department.
2. The qualification acceptance organ is responsible for checking the original materials provided by the enterprise, which shall be kept by the enterprise. After the formal acceptance by the qualification licensing authority, all materials shall not be replaced, modified or returned. If the relevant competent department at a higher level has doubts about the application materials of the enterprise, the enterprise shall provide the original relevant materials and cooperate with relevant departments to conduct on-the-spot investigation when necessary.
3. The attached materials should be arranged and bound in the order of "comprehensive data, personnel data and engineering performance data", with A4(21×297mm) paper size, a general catalogue with page numbers and application instructions. It is recommended to use soft cover and back cover, and write page numbers page by page.
the materials declared by the enterprise must be in Chinese, and the original materials are in other languages, which must be accompanied by a Chinese translation and translated accurately.
4. The application materials must be complete in data, standardized in filling in the form, complete in seal and legible in handwriting, and the copies must be clear and legible.
iv. renewal of qualification certificate and application materials
1. enterprises should apply for the renewal of the validity period of qualification certificate 6 days before its expiration. For the third-level qualification licensed by the Provincial Construction Department, the enterprise shall apply for renewal to the municipal construction administrative department where the enterprise is registered 6 days before the expiration of the validity period, and the municipal construction administrative department where the enterprise is registered shall give the renewal opinions. The rest of the qualification of construction enterprises licensed by the Provincial Department of Construction, enterprises before the expiration of the validity period of 6 days, to the municipal construction administrative department where the enterprise is registered to apply for renewal, the municipal construction administrative department where the enterprise is registered shall report it to the Provincial Department of Construction uniformly, and the Provincial Department of Construction shall give opinions on renewal. Central enterprises in Shaanxi, provincial SASAC management enterprises and their subordinate enterprises and other provincial departments and bureaus subordinate enterprises to apply for renewal, directly reported to the provincial construction department.
2. If the enterprise abides by relevant laws, regulations, rules, technical standards and professional ethics within the validity period of the qualification certificate, and has no bad records, and the registered capital and professional and technical personnel meet the standard requirements, with the consent of the qualification licensing authority, it will issue an opinion on the copy of its qualification certificate that the validity period will be extended for five years; If there are illegal acts, bad records or changes in the qualification conditions of enterprises, the qualification licensing organ shall re-approve their qualifications.
3. If an enterprise applies for qualification renewal within 6 days before the expiration of the validity period of the qualification certificate, the qualification acceptance department may accept its application, but the qualification certificate will be invalid from the expiration date to the time when the extension is approved. If the validity period of the qualification certificate has not been extended, its qualification certificate will automatically become invalid. If you need to continue to carry out engineering construction activities, enterprises must re-apply for the qualification of construction enterprises.
4. Renewal of qualification certificate Provide the following information
(1) Application Form for Renewal of Qualification of Construction Enterprises
(2) Copy of business license of enterprise as a legal person;
(3) the original and duplicate of the enterprise qualification certificate;
(4) the registration certificate of the enterprise registrant.
v. Time for acceptance and time limit for examination and approval
1. The Provincial Construction Department accepts the application materials of construction bureaus (construction committees) of all districts and cities, enterprises directly under the central government in Shaanxi and enterprises applying for first-class qualification five working days before every two months.
2. When submitting the application materials, the enterprise shall provide the originals of all supporting documents so that the accepting department can check with the copies of the attachment materials.
3. The construction qualification applied by the enterprise shall be approved or disapproved within 2 working days after it is accepted by the Construction Department; The qualification related to transportation, water conservancy, communication, etc. will be approved or disapproved by the construction department after the relevant departments and bureaus return the audit opinions.
4. The first-class qualification of construction general contracting and first-class qualification of professional contracting applied by enterprises shall be completed within 2 working days after being accepted by the Construction Department; Which involves transportation, water conservancy, communications and other aspects of qualifications, from the construction department to complete the preliminary examination within 45 working days after acceptance; After the preliminary examination, it shall be submitted to the Ministry of Construction for approval within the time specified by the Ministry of Construction.
