The Regulations on National Defense Patents is a law mainly aimed at the patent problems encountered in national defense construction, which came into effect on June 1 65438+1October1day, 2004. Novelty of national defense patent means that no identical invention has been published in foreign publications, published in domestic publications, used in China or known to the public in other ways before the application date, and no identical invention has been applied for by others and won the national defense patent right after the application date.
Compared with ordinary patent applications, the confidentiality of national defense patents will definitely lead to blind spots and misunderstandings in patent retrieval and analysis, which will lead to poor communication within military enterprises, repeated research and development, and waste of manpower and material resources. This also means that the birth of national defense patent is a violation of the patent system.
