This standard specifies the numbering rules for patent application numbers.
This standard is applicable to any unit or individual who uses the China patent application number for various purposes in any way at any place, especially for legal procedures and document disclosure.
2 Terms and definitions
The following terms and definitions apply to this standard. Unless otherwise stipulated by national laws, China National Intellectual Property Administration has the final right to interpret the terms and definitions used in this standard.
2. 1 patent application
Patent applications mentioned in this standard include applications for invention patents, utility model patents and design patents.
2.2 patent application number
The patent application number refers to the identification number given to the patent application in China National Intellectual Property Administration when it is accepted.
2.3 parity bit
Parity refers to 1 Arabic numerals (0 to 9) or capital English letter x calculated by using the number combination used in the patent application number as the source data.
3 formulate principles
3. 1 uniqueness principle
In order to make a patent application obviously different from any other patent application in patent-related acceptance, examination and other legal procedures, the numbering rules of patent application numbers formulated in this standard embody the principle of uniqueness.
The principle of uniqueness has two meanings: the first meaning is that China National Intellectual Property Administration only gives a patent application a patent application number in the examination procedure of patent application and other related legal procedures, as well as during the duration of the patent right obtained by the patent application. This patent application number will not change due to the modification of the contents of the patent application documents, the change of the legal status of the patent application and the change of the inventor/designer, patent applicant or patentee. The patent application number will not change due to division. In the case of filing a divisional application based on a patent application (mother case), the divisional application will have a new patent application number, while the mother case application will remain the original patent application number. The second meaning is that a patent application number can only be used for one patent application, even if a patent application or the patent right obtained from it is lost, it is no longer possible for any other patent application to use the patent application number.
3.2 Scientific principles
Because the legal protection and technical information function of the patent system have extensive sociality and long-term timeliness, the patent application number is required to be unique, which is beneficial to information management, easy to understand and remember, and convenient to use. Therefore, scientific numbering rules were adopted when formulating this standard. The patent application number includes the year number indicating the acceptance of the patent application, the category number indicating the type of patent application and the serial number indicating the relative order of the patent application.
4 numbering rules for patent application numbers
4. 1 Composition of patent application number
The patent application number is represented by 12 digits, including the application year number, application category number and application serial number.
According to the order from left to right, the number 1-4 in the patent application number indicates the year when the patent application was accepted, the number 5 indicates the type of the patent application, and the number 6- 12 (***7) indicates the serial number of the application, indicating the relative order of accepting the patent application.
Every Arabic numeral used in the patent application number is decimal.
4.2 application year number
The year number in the patent application number adopts AD year. For example, 2004 indicates that the year of patent application acceptance is AD 2004.
4.3 Application Type Number
The application category number in the patent application number is represented by 1 digit, and the meanings of the digits used are as follows: 1 stands for invention patent application; 2 represents an application for a patent for utility model; 3 represents an application for a patent for design; 8 denotes the PCT invention patent application that entered the national stage in China; 9 denotes the PCT utility model patent application that entered the national stage in China.
The meaning of other Arabic numerals not included in the above-mentioned application category number when used as category number shall be stipulated separately by China National Intellectual Property Administration.
4.4 Application for serial number
The application serial number in the patent application number is represented by 7 consecutive digits, which are generally used in ascending order, for example, from 000000 1 to 99999.
The application serial number in the patent application number of each natural year is rearranged, that is, from 65438+1 October1every year, the application serial number in the newly issued patent application number is rearranged from 00000 1 instead of the application serial number used in the previous year.

5. 1 Joint use of patent application number and parity bit
China National Intellectual Property Administration gave the patent application number and check bit when accepting the patent application. The check bit is located after the patent application number, and the subscript single-byte real dot symbol is used as the separator between the patent application number and the check bit. Unless otherwise provided by laws, regulations and administrative rules, the patent application number and the check bit (including the separator between them) are used together in various legal procedures stipulated in the Patent Law, the detailed rules for the implementation of the Patent Law and other relevant provisions.
5.2 Joint use of patent application number and China country code CN
China country code CN can be used in combination with the patent application number to indicate that the patent application was accepted by China National Intellectual Property Administration, China. CN code should be located before the patent application number. If necessary, a single-byte space of 1 bit can be used between CN and the patent application number.
5.3 Writing and printing format of patent application number
Unless laws, regulations and administrative rules stipulate that all digits of the patent application number (including digits combined with check digits) must be written or printed continuously, 1 single-byte space can be used between the year number and classification number of the patent application number and between the classification number and serial number respectively.
In the numeric fields representing years and serial numbers, spaces shall not be used between serial numbers and spacers, or between spacers and parity bits.
Except as specified in paragraphs 1, 5.2 and 5.3, no other words, numbers, symbols or spaces shall be used as part of the patent application number before, after or during the patent application number (including the case of combining with check bits).
