(a) when the data has been transmitted but the paper has not been sent, if the agency finds that there is an error in the file processing, it should immediately report the application number and the wrong content to the Patent Office, and at the same time modify the paper and correct the local database, and the Patent Office will correct the transmitted data.
(2) After the data has been transmitted and the paper has been sent, if the agency finds that there is an error in the document processing, it shall immediately report the application number and the wrong content to the Patent Office, and the Patent Office shall correct it.
(3) After receiving the documents and loading the data into the database, the receiving office of the Patent Office finds that the agency has made mistakes in handling the application documents, and shall handle them in the following ways:
1. If there is an error in the list of items or documents recorded in the patent application, it shall be revised by the acceptance office of the Patent Office, and a notice of revision and correction shall be issued to inform the applicant.
2. If the application date is wrong, the agency shall provide post office vouchers for the documents sent by the applicant. With the consent of the patent office, the receiving office shall re-determine the date of the patent application, modify the documents and materials, make a notice to re-determine the application date, and then serve it on the applicant.
3. If the application category is determined incorrectly, the Patent Office shall promptly notify the relevant agency. After receiving the notice from the Patent Office, the agency shall submit a report requesting to correct the error, and the agency shall explain the reasons for the error, and the person in charge of the agency shall sign an opinion and report it to the competent leader for approval and filing. Documents with errors should be re-inspected by the acceptance office.
4. If there is an error in the examination and approval of fee reduction, the acceptance office of the Patent Office shall verify the original, make a Notice of Amendment and Correction and notify the applicant.
