If new plant varieties are found, Item 4 of Article 25 of China's Patent Law clearly stipulates that no patent right shall be granted to plant and animal varieties, but the method of producing plant and animal varieties can still be protected by the patent law.

Most countries do not grant patents to new varieties of animals and plants, but prefer to protect them in other ways. For example, China promulgated the Regulations on the Protection of New Plant Varieties in 1997. You can refer to the relevant provisions in this regulation.

If it is indeed a plant that has not been discovered before, you can have the right to name it first, that is, Latin nomenclature.
