Applying for a patent for design or utility model does not require substantive examination, so the time is relatively short, about six months to one year. The general process is as follows: if the application is not rejected after preliminary examination, the patent administration department of the State Council makes a decision to grant the patent right for utility model or design, issues the corresponding patent certificate, and registers and announces it at the same time. The patent right for utility model and the patent right for design shall take effect as of the date of announcement.
