Legal analysis: China's patent law stipulates that an invention-creation applying for a patent shall not lose its novelty, creativity and practicality. Patents have three characteristics: novelty, creativity and practicality. Novelty means that the technology has not been used or published at home and abroad, has not been applied by others, and has not been recognized by the public in other aspects. Creativity means that inventions are more practical and progressive than other inventions. Practicality means that this invention can be made and used to facilitate people's lives and benefit society.
Legal basis: Article 24 of the Patent Law of People's Republic of China (PRC). An invention-creation for which a patent is applied shall not lose its novelty if it is under any of the following circumstances within six months before the date of filing: (1) It was exhibited for the first time at an international exhibition sponsored or recognized by the China Municipal Government; (2) It was first published at a specific academic conference or technical conference; (3) being leaked by others without the consent of the applicant.
