Sign an entrustment contract with a patent agency or patent agent to provide relevant information about the patent that needs to be represented. A patent agent is a person who represents others in patent applications and other patent affairs and obtains certain qualifications. Article 14 of the Patent Agency Regulations stipulates that when a patent agency accepts entrustment, it shall conclude a written entrustment contract with the client. After accepting the entrustment, a patent agency shall not accept the entrustment of other parties with conflicts of interest on the same patent application or patent right. A patent agency shall entrust a patent agent practicing in the agency to undertake the patent agency business, and the entrusted patent agent himself and his close relatives shall not have conflicts of interest with the patent agency business undertaken by him.
Legal objectivity:
Article 15 of the Detailed Rules for the Implementation of the Patent Law of People's Republic of China (PRC) shall be filed in writing, and the application documents shall be submitted to the patent administration department of the State Council in duplicate. To apply for a patent in other forms prescribed by the administrative department for patent in the State Council, the prescribed conditions shall be met. Where the applicant entrusts a patent agency to apply for a patent and handle other patent affairs with the patent administration department of the State Council, it shall also submit a power of attorney, indicating the authorization authority. If there are more than two applicants who have not entrusted a patent agency, unless otherwise stipulated in the request, the first applicant specified in the request shall be the representative.
