Counterfeit patent mainly refers to marking counterfeit patent number on products without patent right. This imitation can be understood as a patent number fabricated at will, which just violates the civil law; Counterfeiting another person's patent means marking the patent number owned by another person on the product without patent right. The marked number is real, but it doesn't belong to this person. In this case, the legal responsibility is greater than impersonating a patent. If the circumstances are serious, it may violate the civil law and criminal law, and may be sentenced to fixed-term imprisonment of not more than five years (maybe the years are wrong, for reference only).
