It is very beneficial for students to choose a double-degree major in law (intellectual property direction) (hereinafter referred to as the double-degree major in intellectual property). Because this major is the first time to enroll students, in order to let students fully understand the benefits of choosing this major, I will make the following explanations on the related issues that students care about.
First, there is a large demand for intellectual property professionals.
Intellectual property rights mainly involve patents, trademarks, copyrights and trade secrets. Now intellectual property is infiltrating into other industries and fields.
After China's accession to the World Trade Organization, foreign-related intellectual property disputes in China have emerged in an endless stream under the background of foreign multinational companies swarming in and domestic enterprises going out. However, there are only a handful of legal talents who can handle these foreign-related intellectual property lawsuits in China, and they often have to turn to "outsiders" (hiring lawyers abroad). In terms of foreign-related intellectual property management, there are also few professionals who can skillfully operate international intellectual property transfer, licensing and international technical standards. In government and enterprises, there is a great demand for talents. Therefore, the Eleventh Five-Year Plan for Intellectual Property Talents points out that the number, structure, quality and ability of intellectual property professionals in China cannot meet the needs of economic and social development, and there is a serious shortage of high-level compound talents urgently needed for the development of intellectual property. During the Eleventh Five-Year Plan period, it is more urgent to strengthen the work of intellectual property talents. Although China has strengthened the training of intellectual property talents in recent years, the overall demand is still in short supply. With China's entry into WTO, the level of national protection of intellectual property rights has been greatly improved, which is followed by a shortage of intellectual property talents. According to statistics, the current intellectual property talent gap in China is1-200,000.
The government, enterprises and society need a large number of compound talents with both professional backgrounds such as science and engineering management and intellectual property rights.
Second, intellectual property dual-degree employment is good and there are many employment channels.
Intellectual property talents have more employment channels and higher employment rate than ordinary talents. It is reported that there are 30 graduates from the 2005 intellectual property double-degree class of Peking University Intellectual Property Institute, among whom 26 are employed, with an employment rate of 93%, and 4 are self-employed. Compared with the employment rate of 865,438+0% graduates of Peking University Law School in 2005, it is much higher. At present, there are no graduates majoring in intellectual property in colleges and universities, and only a few colleges and universities offer dual-degree majors in intellectual property. Only East China Jiaotong University in Jiangxi started to offer this major in 2007. Judging from the employment situation of other universities with intellectual property dual-degree graduates, generally speaking, the employment direction of intellectual property talents includes:
1. government departments:
After graduating with a double degree in intellectual property, I entered the government departments involved in intellectual property. Mainly includes:
① Intellectual Property Offices: including China National Intellectual Property Administration, provincial intellectual property offices and municipal intellectual property offices. When the staff of other government departments tend to be saturated, intellectual property offices at all levels are in a period of large-scale recruitment. In 2007, China National Intellectual Property Administration plans to recruit 570 civil servants, becoming the government department with the largest number of civil servants recruited by the central state organs. Other central ministries and commissions generally only recruit a dozen people, and few ministries and commissions recruit civil servants above 100. The provincial and municipal intellectual property offices are also in the expansion stage.
(2) Trademark office or trademark administration department: The current trademark office or trademark administration department is generally located under the Administration for Industry and Commerce and also needs intellectual property talents.
(3) Copyright Bureau: The Copyright Bureau is generally subordinate to the Press and Publication Bureau and needs intellectual property professionals.
④ Government departments such as Tourism Bureau, Cultural Bureau, Bureau of Quality and Technical Supervision, Bureau of Commerce, etc.: As intellectual property is now infiltrating into other fields, other departments will also need intellectual property talents. For example, the Tourism Bureau needs to manage the intellectual property rights of scenic spots, the Bureau of Quality and Technical Supervision needs to manage the intellectual property rights of standardization, the Cultural Bureau needs to manage the intellectual property rights of cultural products, and the Department of Commerce needs to manage the intellectual property rights of brands.
In addition, intellectual property talents can also serve as intellectual property teachers, staff of various training institutions and associations, journalists and editors. Some students have been admitted to the Master of Intellectual Property.
2. Enterprises:
At present, enterprises in China are encountering more and more international intellectual property disputes, but there are few domestic intellectual property senior talents who can deal with these lawsuits. "The existing intellectual property professionals are mainly concentrated in professional service institutions such as patent offices and judicial fields, and the intellectual property law and management talents of a large number of enterprises and institutions are almost blank." Xu Weihua, director of the Enterprise Intellectual Property Promotion Division of the Intellectual Property Service Center of the Shanghai Intellectual Property Office, believes that in recent years, some enterprises suffering from intellectual property rights have begun to attach importance to intellectual property rights and have begun to introduce a considerable number of intellectual property talents. The bigger the enterprise, the more intellectual property talents are needed.
Judging from the current demand of domestic enterprises, the demand for two types of professionals is the most concentrated:
(1) Director of Intellectual Property and other management personnel.
The intellectual property supervisor has many responsibilities, which mainly involve: being responsible for the application, maintenance and daily management of enterprise patents and trademarks; Establish a trade secret protection system and supervise its implementation; Information retrieval before the establishment of scientific research and development projects, as well as the collection of scientific research logs and records and the establishment of files; Communicate with lawyers in case of intellectual property disputes and prepare relevant materials; When enterprises engage in trade or cooperation with foreign enterprises, protect the rights and interests of enterprises on issues involving intellectual property rights. In addition, the intellectual property supervisor is also responsible for the intellectual property training of employees in the enterprise, communicating and coordinating various departments, and doing a good job in intellectual property management. At present, the recruitment of intellectual property directors and related managers is mainly large enterprises, and there are also many industries with high technology content.
(2) Legal personnel who understand intellectual property rights.
3. The Court:
Due to the late start of intellectual property education in China, few people have been trained so far. At present, most of the intellectual property judges in the court are original judges and have not received systematic intellectual property education. In the face of intellectual property trials with numerous cases and complicated technical details, many judges are often overwhelmed, and the trial level and efficiency need to be improved urgently. Because people with legal knowledge are not familiar with science and engineering or economic management, and people with legal majors are not necessarily familiar with intellectual property rights, the best judge is a compound talent with both professional backgrounds such as science and engineering or economic management and intellectual property rights, so that judges can be handy.
4. Patent examiners:
Patent examiners must have a high comprehensive quality, and only compound talents can undertake this important task. Patent examiners, especially when he invented Patent examiners, must know technology, be proficient in law and foreign languages. At present, there are 349 examiners of invention patents and more than 500 examiners of utility models and designs in China National Intellectual Property Administration. Compared with hundreds of patent applications every year, this is undoubtedly a rather heavy task. China National Intellectual Property Administration's goal is to greatly increase Patent examiners's inventions. China National Intellectual Property Administration's next step is to go directly to colleges and universities for recruitment.
5. Lawyer:
A suitable lawyer is very important for intellectual property protection. This requires intellectual property legal knowledge, professional background, good insight, persuasion and creativity in order to obtain comprehensive and meticulous protection. However, the current situation is that many lawyers don't even understand the most basic patent cases. Therefore, at present, there is a lack of lawyers who not only know the legal knowledge of intellectual property rights, but also have other professional backgrounds.
6. Intellectual property agents such as patent agents and trademarks.
The specific duties of patent agents include writing applications for inventors, defending and correcting the opinions of patent office examiners, and helping inventors handle court proceedings in case of disputes. If a foreign-related patent agent is involved, the patent agent will also translate the foreign materials into Chinese and make amendments according to the patent law. Therefore, the quality of the application is related to the "life and death" of the patent. At present, China needs a large number of high-quality patent agents to improve the level of patent application, because China enterprises will eventually become competitors in the world market, and more high-quality patents will enhance their international competitiveness. China's early patent agents were also trained. Later, some of them retired, while others switched to other jobs. At present, there are more than 400 patent agencies with nearly 4000 employees in China, and the existing patent agencies are far from meeting the market demand. Moreover, intellectual property disputes will increase day by day in the future. More inventions need patent agents to help inventors or units turn inventions into their own intellectual property rights and strive for related rights, and patent agents will become more and more popular. Trademark and copyright agency also have similar problems, which are also in short supply.
Third, the double degree in intellectual property is highly paid.
According to people in the patent and trademark agency industry, the main income of patent agents comes from business commissions, and the proportion of each business commission of employees is about 35%. This is a fairly high proportion. At present, in China, the agency fee for an application for a patent for invention is about 4500 to 5500 yuan, and the agency fee for a patent for design and utility model is about 2000 yuan. People in the industry have calculated an account: every time you make a patent application document, you can get a commission of about 700-2000 yuan, and the income is considerable; Patent litigation cases are generally based on the subject matter of the case, and the agency fee is negotiated by both parties. From this calculation, the average annual salary of an ordinary patent agent should be more than 6,543,800 yuan, while the annual salary of a well-done employee can reach more than 200,000 yuan, and the annual salary of a novice will be between 60,000 and 6,543,802 yuan. On the other hand, partners earn more because they own shares in the company.
The treatment of working in the government varies with different government departments engaged in intellectual property management.
Lawyers and other practitioners engaged in intellectual property litigation are also better treated than ordinary people.
Fourth, the advantages of students with different majors in studying intellectual property double degrees
Students of different majors have their own advantages in learning intellectual property rights:
1. Science and engineering: Because of the background knowledge of science and engineering, it is easy for them to learn patent knowledge, laying a good foundation for enterprises entering the high-tech field to engage in related work and patent agency in the future. Moreover, they can also engage in the work of intellectual property informatization.
2. Management: These students have a solid knowledge base of economic management style. If they have intellectual property knowledge and skills, they will certainly be able to add wings to intellectual property management. In addition, they can also engage in work related to trademarks and brand strategies.
3. Economy and trade: International trade in intellectual property rights is a new industry and an important branch of international trade. Such students can take advantage of their intellectual property rights and give full play to their talents in international trade.
4. Foreign languages: What China lacks most at present are talents who know both English, law and intellectual property. For example, a patent office in Shanghai offers a monthly salary of 30,000 to 40,000 yuan, but it is still difficult to find a fluent intellectual property professional. Foreign language students have great potential in this field.
5. Music and other arts: works of art need to enter the market to get the best benefits. Art majors know intellectual property rights, and they can shine in the field of copyright management.
In addition to the law major, students of other majors can choose to take a double degree in intellectual property in 2006. Grade 2005 can choose a double degree in intellectual property.
