The prototype of the first patent law of the Republic of China was the "Interim Regulations for Rewarding Handicrafts" promulgated by the Ministry of Industry and Commerce on December 12, 1911. The regulations have revealed the "first to apply principle", "right transfer", "Legal responsibility" and other important concepts. The "Interim Regulations for Rewarding Industrial Technology" promulgated in 1932, its implementation details, and the "Rules for the Review Committee for Rewarding Industrial Technology" constitute a relatively complete system and are the basis for the current patent law framework of the Kuomintang government.

On May 4, 1944, the Kuomintang government passed the first law in the history of our country called the "Patent Law" at the 206th session of the fourth session of the "Legislative Yuan". Although it has been revised many times since then, the changes have not been major. However, in 1994, the Taiwan authorities made major changes to cooperate with its industrial development and return to the World Trade Organization.
