Decree No.7 of the Patent Office of China-Provisions on Amending the Implementation of the Patent Cooperation Treaty in China

First, the first paragraph of article thirty-sixth is amended as:

"The international application to designate China or China involves new microorganisms, microbiological methods or their products, and the microorganisms used are not available to the public. The applicant shall, at the latest, submit the preservation of microbial strains to the preservation unit that has obtained the qualification of international preservation unit in accordance with the Budapest Treaty. " Two, the second paragraph of article thirty-sixth is amended as:

"Where the applicant submits the preservation certificate of microbial strains in accordance with the provisions of the preceding paragraph, it shall submit the preservation certificate and survival certificate issued by the international preservation unit within three months from the expiration of the time limit stipulated in Article 19 or Article 20 of these Provisions; If the certificate is not submitted at the expiration date, the strain shall be deemed as not submitted for preservation. "

The above amendments shall come into force as of July 1995.
