How to transfer the patent?

1. Patent assignment refers to a contract in which the patentee, as the assignor, transfers the ownership or holding right of his invention-creation patent to the assignee, and the assignee pays the agreed price. The party who obtains the patent right through the patent right transfer contract becomes a new legal patentee, and may also conclude a patent transfer contract and a patent licensing contract with others.

2. Once the patent transfer right takes effect, the transferee gains the status of patentee and the transferor loses the status of patentee. The patent transfer contract shall not affect the effectiveness of the transferor entering into a patent licensing contract with others before the establishment of the contract. Unless otherwise agreed in the contract, the rights and obligations stipulated in the original patent licensing contract shall be borne by the patent transferee. In addition, if the transferor has already exploited the patent before concluding the patent right transfer contract, unless otherwise agreed in the contract, the transferor shall stop the exploitation after the contract is established.

3. When the patent right belongs to more than two patentees, sometimes, if one party transfers its sole patent right, the other party can get its share first.
