How long does it take from patent application to authorization?
-Le Weiguo, the intellectual property lawyer and patent agent of this site, replied: As the time for obtaining the patent right involves the staffing, examination process and efficiency of the national patent examination department, only the reference time can be given. Judging from the current review, it takes about one to three years for a general invention patent to be granted. At present, the examination speed in China National Intellectual Property Administration is accelerated, and the authorization speed of utility model patents and design patents is also shortened. Because utility model and design patents do not undergo substantive examination, they can generally be authorized within one year. Applicants with special circumstances can apply for speeding up the examination if they meet certain conditions. Among them, the application for a patent for invention is limited to published applications. After the application for accelerated review is approved by the local intellectual property office, it will enter the accelerated review procedure. Speeding up review can generally shorten the review time by about half a year.
