(1) Where the same invention or utility model is filed in China, the domestic and international priority period shall be within 12 months before the filing date;
(2) Time limit for foreigners to apply for foreign priority in China for the same design: within 6 months before the date of application;
(3) If a foreign applicant claims foreign priority, the time limit for providing the certificate issued by the foreign patent acceptance authority: within 3 months from the date of filing;
(4) Time limit for the invention and creation to be exhibited for the first time at an international exhibition sponsored or recognized by the China Municipal Government, or published for the first time at a designated academic conference, or leaked by others without the consent of the applicant, without losing novelty: within 6 months before the date of application;
(5) Time limit for submitting certificates of the above exhibitions and academic conferences: within 2 months from the date of application;
(6) The invention involves new microorganisms, microbiological methods or their products, and the microorganisms used are not available to the public, and the date of preservation of microorganisms: before the date of application at the latest;
(7) Time limit for submitting the above-mentioned microbial preservation certificate and survival certificate: within 3 months from the date of application;
(8) Payment period of patent application fee: within 2 months from the date of application;
(9) Time limit for an application for a patent for invention to voluntarily modify the application: when making a request for substantive examination, when replying to the opinions of the first examination;
(10) Time limit for active modification of the application for a patent for utility model or design: within 3 months from the date of application;
(1 1) Time limit for early publication of the invention patent: within 3 years from the application date (or priority date);
(12) Time limit for substantive examination of an application for a patent for invention: within 3 years from the filing date (or priority date);
(13) The payment period of the maintenance fee for the application for a patent for invention is two years from the date of application, and it shall be paid annually from the third year;
(14) Time limit for filing divisional application: before the original case authorization notice is issued;
(15) Time limit for filing administrative reconsideration: within 15 days after receiving the notice from the Patent Office;
(16) According to Article 7 of the Detailed Rules, the time limit for requesting the restoration of rights: within 2 months after receiving the notice;
(17) Time limit for the applicant to request reexamination: within 3 months after receiving the rejection decision; (18) If the applicant refuses to accept the review, the time limit for bringing a lawsuit to the court: within 3 months after receiving the review decision;
(19) patent registration period: within 2 months after receiving the notice;
(20) Term of invention patent right: from the date of application/before KLOC-0/993, after 20 years from the date of application;
(2 1) Term of patent right for utility model or design: for applications before 1993, five years from the date of application, which can be extended for three years; For applications after 1993, from the date of application 10 year;
(22) Extension period for applying for maintenance fee and annual fee: within 6 months from the date of expiration or expiration;
(23) Time limit for filing the patent licensing contract or assignment contract with the Patent Office: within 3 months from the date when the contract comes into effect;
(24) Limitation of action for patent infringement: within 2 years from the date when the patentee should know of the infringement;
(25) Time limit for requesting compulsory patent license: 3 years from the date of publication;
(26) If the patentee refuses to accept the compulsory license or its fee decision, the time limit for bringing a lawsuit to the court is: within 3 months from the date of receiving the decision;
(27) Time limit for bringing a lawsuit to the court against the infringement decision: 3 months from the date of receiving the decision.
