Reason for revision

In 2008, the Ministry of Science and Technology, the Ministry of Finance and State Taxation Administration of The People's Republic of China formulated the Administrative Measures for the Identification of High-tech Enterprises. Before 20 16, the identification of high-tech enterprises was mainly based on the identification method introduced in 2008. With the passage of time, there have been some problems in the implementation of the "Identification Measures": First, the scope of the technical field can not keep up with the development and changes of the industry, and some emerging industries, especially modern service industries, have not been fully reflected in the technical field; Second, the existing certification conditions have not adapted to the development requirements, and the support for small and medium-sized enterprises is not enough. At the same time, according to the requirements of decentralization in the State Council, the identification procedure needs to be optimized, and the follow-up supervision needs to be further strengthened.

Therefore, at the beginning of 20 16, the Ministry of Science and Technology, the Ministry of Finance and State Taxation Administration of The People's Republic of China revised and improved the Administrative Measures for the Accreditation of High-tech Enterprises (hereinafter referred to as the Accreditation Measures) and its annex "High-tech Fields Supported by the State" (hereinafter referred to as the Technical Fields). By adjusting the ratio of R&D expenses to sales revenue, the supporting technology of service industry was expanded, so that more small and medium-sized enterprises could enjoy the high-tech enterprise policy.

Revised content

Main amendments to the Accreditation Measures-

First, the indicator of "R&D expenditure as a proportion of sales revenue" was adjusted. The proportion of R&D expenses for small enterprises will be adjusted from 6% to 5%, and the requirements of 3% and 4% for large and medium-sized enterprises will remain unchanged. Mainly reflects the inclined support for small and medium-sized enterprises, so that more small and medium-sized enterprises can enjoy the preferential policies of high-tech enterprises.

The second is to adjust the "proportion of scientific and technological personnel" index. The current "scientific and technical personnel with college degree or above accounted for more than 30% of the total employees of this enterprise in that year, among which R&D personnel accounted for more than 10% of the total employees of this enterprise in that year" was adjusted to "the proportion of scientific and technical personnel engaged in R&D and related technological innovation activities in this enterprise accounted for not less than 10% of the total employees of this enterprise in that year". Mainly considering the trend of R&D outsourcing and open crowdsourcing, enterprises are increasingly relying on external forces to carry out R&D activities, and this revision will be more suitable for the development needs of enterprise R&D innovation.

The third is to adjust the requirements for intellectual property rights. The restrictions on obtaining intellectual property rights in the last three years and the way of obtaining intellectual property rights by exclusive license for more than five years have been abolished. Mainly to encourage independent research and development of enterprises to avoid the abuse of intellectual property rights. In addition, enterprises can still obtain intellectual property rights through technology transfer, which is conducive to the better implementation of the newly revised Law on Promoting the Transformation of Scientific and Technological Achievements.

The fourth is to optimize and simplify the logo management process. Change the publicity time from 15 working day to 10 working day; The name of the enterprise is no longer reported to the office of the leading group for the record; Decentralize the filing management of local evaluation experts to local evaluation institutions.

The fifth is to strengthen inspection and supervision. The fourth chapter of the current Accreditation Measures is changed from "punishment" to "supervision and management", which clearly strengthens inspections by combining filing with follow-up supervision, and combining random checks with key inspections, and puts forward responsibility requirements for accreditation institutions, reporting enterprises, intermediaries and evaluation experts according to different situations.

The sixth is to absorb the relevant contents of the pilot policy of high certification management in Zhongguancun National Independent Innovation Demonstration Zone, and incorporate "national new drugs, national first-class protected varieties of traditional Chinese medicine, national crop variety approval and national defense patents" into intellectual property rights; Provisions on the identification of newly added classified enterprises; All supporting technologies involved in the cultural industry in the pilot are included in the "technical field".

The seventh is to increase the content of mutual recognition of qualifications of enterprises relocated from different places. In order to promote inter-regional industrial transfer and coordinated development, the new "Accreditation Measures" added the content of mutual recognition of qualifications of enterprises relocated from different places, and made it clear that the original high-tech enterprise qualifications of enterprises relocated across the region where the accreditation institution is located will continue to be valid.

Adjustment in the technical field-

There are some additions and deletions in the technical field, absorbing new technologies and eliminating backward technologies. Specifically including:

1. Expand the supporting technology of service industry. For example, increase new service industry support technologies such as inspection and certification, modern sports services and smart cities; It supplements the original R&D and emerging industrial technologies such as design services, information technology services, cultural creativity, e-commerce and modern logistics.

2. Add new technologies and eliminate backward technologies. Advanced technologies such as new additive manufacturing, preparation and application of graphene materials, monitoring of major natural disasters, early warning and emergency, testing of new energy vehicles and infrastructure; At the same time, backward industrial technology and product content have been deleted.

3. Enhance the normative and technical content. Highlight key technologies in various fields, remove industry and product descriptions as much as possible, and strive to be accurate, precise and standardized.

The newly revised Administrative Measures for the Identification of High-tech Enterprises will be jointly issued by the Ministry of Science and Technology, the Ministry of Finance and State Taxation Administration of The People's Republic of China in the near future. At the same time, the three departments are working hard to compile a new "Guide to the Identification and Management of High-tech Enterprises" to make the policies more detailed and operational, and will strengthen the publicity and explanation of the policies so as to implement them as soon as possible.

Note: The 20 16 revised Administrative Measures for the Accreditation of High-tech Enterprises has not been formally promulgated and implemented, and specific work guidelines are being compiled.
